  1  1    Amend Senate File 503, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  Section 455B.161, subsection 2,
  1  6 paragraph b, Code 2001, is amended to read as follows:
  1  7    b.  A runoff control settled open feedlot effluent
  1  8 basin which that collects and stores only
  1  9 precipitation-induced runoff from an animal feeding
  1 10 operation in which animals are confined to areas which
  1 11 are unroofed or partially roofed and in which no crop,
  1 12 vegetation, or forage growth or residue cover is
  1 13 maintained during the period in which animals are
  1 14 confined in the operation an open feedlot.
  1 15    Sec. 2.  Section 455B.161, Code 2001, is amended by
  1 16 adding the following new subsection:
  1 17    NEW SUBSECTION.  18A.  "Open feedlot" means an
  1 18 unroofed or partially roofed animal feeding operation
  1 19 if crop, vegetation, or forage growth or residue cover
  1 20 is not maintained as part of the animal feeding
  1 21 operation during the period that animals are confined
  1 22 in the animal feeding operation.
  1 23    Sec. 3.  Section 455B.171, Code 2001, is amended by
  1 24 adding the following new subsections:
  1 25    NEW SUBSECTION.  23A.  "Open feedlot" means the
  1 26 same as defined in section 455B.161.
  1 27    NEW SUBSECTION.  38A.  "Settled open feedlot
  1 28 effluent" means a combination of manure,
  1 29 precipitation-induced runoff, or other runoff
  1 30 originating from an open feedlot after its settleable
  1 31 solids have been removed.
  1 32    NEW SUBSECTION.  38B.  "Settled open feedlot
  1 33 effluent basin" or "basin" means an impoundment which
  1 34 is part of an open feedlot, if the primary function of
  1 35 the impoundment is to collect and store settled open
  1 36 feedlot effluent.
  1 37    Sec. 4.  NEW SECTION.  455B.205A  CONSTRUCTION
  1 38 DESIGN STANDARDS – SETTLED OPEN FEEDLOT EFFLUENT
  1 39 BASINS.
  1 40    If the department requires that a settled open
  1 41 feedlot effluent basin be constructed according to
  1 42 design standards, regardless of whether the department
  1 43 requires the owner to obtain a construction permit
  1 44 under section 455B.200, all of the following shall
  1 45 apply:
  1 46    1.  Any design standards for a basin shall be
  1 47 established by rule as provided in chapter 17A that
  1 48 exclusively account for special design characteristics
  1 49 of open feedlots and related basins, including but not
  1 50 limited to the dilute composition of settled open
  2  1 feedlot effluent as collected and stored in the
  2  2 basins.
  2  3    2.  The design standards for the basin shall be
  2  4 less restrictive than the design standards governing a
  2  5 confinement feeding operation's manure storage
  2  6 structure required to be constructed pursuant to a
  2  7 construction permit as provided in section 455B.200A,
  2  8 regardless of whether the design standards for the
  2  9 manure storage structure are provided by statute or
  2 10 departmental rule."
  2 11    #2.  Title page, by striking lines 1 through 3, and
  2 12 inserting the following:  "An Act relating to open
  2 13 feedlots, by providing for standards of construction
  2 14 for pollution control structures."
