1 2 #1. Page 1, by striking lines 1 through 23 and
1 3 inserting the following:
1 4 "Sec. . NEW SECTION. 356.36A CONFINEMENT AND
1 5 DETENTION REPORT – DESIGN PROPOSALS.
1 6 The division of criminal and juvenile justice
1 7 planning of the department of human rights, in
1 8 consultation with the department of corrections, the
1 9 Iowa state sheriff's association, the Iowa association
1 10 of chiefs of police and peace officers, a statewide
1 11 organization representing rural property taxpayers,
1 12 the Iowa league of cities, and the Iowa board of
1 13 supervisors association, shall prepare a report
1 14 analyzing the confinement and detention needs of jails
1 15 and facilities established pursuant to chapter 356A.
1 16 The report for each type of jail or facility shall
1 17 include but is not limited to an inventory of prisoner
1 18 space, daily prisoner counts, and the compliance
1 19 status under section 356.36 for each jail or facility.
1 20 The report shall contain an inventory of recent jail
1 21 or facility construction projects in which voters have
1 22 approved the issuance of general obligation bonds,
1 23 essential county purpose bonds, revenue bonds, or
1 24 bonds issued pursuant to chapter 422B. The report
1 25 shall be revised periodically as directed by the
1 26 administrator of the division of criminal and juvenile
1 27 justice planning. The first submission of the report
1 28 shall include recommendations on offender data needed
1 29 to estimate jail space needs in the next two, three,
1 30 and five years, on a county, geographic region, and
1 31 statewide basis, which may be based upon information
1 32 submitted pursuant to section 356.49.
1 33 The governing body of a political subdivision shall
1 34 not appropriate funds to a person to prepare a design
1 35 proposal for the construction of or major modification
1 36 to a jail, alternative jail, municipal holding
1 37 facility, or a facility established pursuant to
1 38 chapter 356A if the person has a financial interest in
1 39 the construction or modification. For purposes of
1 40 this section, "political subdivision" means a county,
1 41 city, or authority created pursuant to section
1 42 346.27."

1 44 word "facilities," the following: "prohibiting
1 45 certain financial interests in the construction of a
1 46 jail or facility,".
