  1  1    Amend House File 637, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 5, by striking line 7, and inserting the
  1  4 following:  "A regional library system is Library
  1  5 service areas are".
  1  6    #2.  Page 6, line 31, by striking the word and
  1  7 figure "section 69.16" and inserting the following:
  1  8 "sections 69.16 and 69.16A".
  1  9    #3.  Page 6, by striking lines 32 and 33.
  1 10    #4.  Page 7, by inserting after line 15 the
  1 11 following:
  1 12    "___.  The commission of libraries shall adopt
  1 13 rules providing for the coordination of appointments
  1 14 made to the board of trustees in accordance with this
  1 15 section."
  1 16    #5.  Page 8, by inserting after line 9, the
  1 17 following:
  1 18    "Sec.    .  Section 256.66, Code 2001, is amended
  1 19 by adding the following new subsection:
  1 20    NEW SUBSECTION.  14.  Shall assume all of the
  1 21 outstanding obligations of the regional library and be
  1 22 liable for and recognize, assume, and carry out all
  1 23 valid contracts and obligations of the regional
  1 24 library that the library service area replaces.  Each
  1 25 regional library in existence prior to July 1, 2001,
  1 26 shall transfer its assets and title to any real estate
  1 27 owned by the regional library to the library service
  1 28 area that replaces the regional library."
  1 29    #6.  Page 13, by striking lines 26 through 32 and
  1 30 inserting the following:
  1 31    "The maintenance of a county library established in
  1 32 accordance with this chapter shall be on the basis of
  1 33 each participating unit bearing its share of the total
  1 34 cost in proportion to its population as compared to
  1 35 the total population of the county library district.
  1 36 The board of library trustees shall make".
  1 37    #7.  Page 14, by inserting after line 19, the
  1 38 following:
  1 39    "This section shall not affect the taxing authority
  1 40 provided under section 256.69."
  1 41    #8.  Page 16, by inserting after line 11, the
  1 42 following:
  1 43    "Sec.    .  Section 669.2, subsection 5, Code 2001,
  1 44 is amended to read as follows:
  1 45    5.  "State agency" includes all executive
  1 46 departments, agencies, boards, bureaus, and
  1 47 commissions of the state of Iowa, and corporations
  1 48 whose primary function is to act as, and while acting
  1 49 as, instrumentalities or agencies of the state of
  1 50 Iowa, whether or not authorized to sue and be sued in
  2  1 their own names.  This definition does not include a
  2  2 contractor with the state of Iowa.  Soil and water
  2  3 conservation districts as defined in section 161A.3,
  2  4 subsection 6, judicial district departments of
  2  5 correctional services as established in section 905.2,
  2  6 and regional library service area boards of library
  2  7 trustees as defined established in chapter 256, are
  2  8 state agencies for purposes of this chapter.
  2  9    Sec.    .  DEPARTMENT OF MANAGEMENT STUDY.  The
  2 10 department of management shall coordinate a study of
  2 11 city and county support of public library funding.
  2 12 The department, in cooperation with the commission of
  2 13 libraries, the Iowa league of cities, and the Iowa
  2 14 state association of counties, shall determine whether
  2 15 cities and counties are in compliance with section
  2 16 256.69 requirements for support of public libraries,
  2 17 identify inequities between city and county funding,
  2 18 and determine the adequacy of the current minimum
  2 19 levy.  The department shall develop a plan to provide
  2 20 those support functions and services more effectively
  2 21 and efficiently.  The department shall submit a report
  2 22 of its findings and recommendations to the
  2 23 chairpersons and ranking members of the senate and
  2 24 house standing committees on education and the joint
  2 25 appropriations subcommittee on education."
  2 26    #9.  Page 16, by striking lines 12 through 18 and
  2 27 inserting the following:
  2 28    "Sec.    .  REGIONAL LIBRARY TERM EXPIRATION DATE.
  2 29 Notwithstanding any provision to the contrary, the
  2 30 terms of the regional library trustees elected in a
  2 31 general election shall expire on July 1, 2001."
  2 32    #10.  By renumbering, relettering, or redesignating
  2 33 and correcting internal references as necessary.
