  1  1    Amend House File 755 as follows:
  1  2    #1.  Page 16, by inserting after line 5, the
  1  3 following:
  1  4    "Sec.    .  Section 232.21, subsection 4, Code
  1  5 2001, as amended by 2001 Acts, Senate File 458,
  1  6 section 5, if enacted, is amended to read as follows:
  1  7    4.  A child placed in a shelter care facility under
  1  8 this section shall not be held for a period in excess
  1  9 of forty-eight hours without an oral or written court
  1 10 order authorizing the shelter care.  When the action
  1 11 is authorized by an oral court order, the court shall
  1 12 enter a written order before the end of the next day
  1 13 confirming the oral order and indicating the reasons
  1 14 for the order.  A child placed in shelter care
  1 15 pursuant to section 232.19, subsection 1, paragraph
  1 16 "c", shall not be held in excess of seventy-two hours
  1 17 in any event.  If deemed appropriate by the court, an
  1 18 order authorizing shelter care placement may include a
  1 19 determination that continuation of the child in the
  1 20 child's home is contrary to the child's welfare and
  1 21 that reasonable efforts as defined in section 232.57
  1 22 have been made.  The inclusion of such a determination
  1 23 shall not under any circumstances be deemed a
  1 24 prerequisite for entering an order pursuant to this
  1 25 section.  However, the inclusion of such a finding
  1 26 determination, supported by the record, may assist the
  1 27 department in obtaining federal funding for the
  1 28 child's placement.
  1 29    Sec.    .  Section 321.113, subsection 5, paragraph
  1 30 b, unnumbered paragraph 1, if enacted by 2001 Iowa
  1 31 Acts, Senate File 350, section 4, is amended to read
  1 32 as follows:
  1 33    If the title of a 1993 model year or older motor
  1 34 vehicle is transferred to a new owner or if such a
  1 35 motor vehicle is brought into the state on or after
  1 36 January 1, 2002, the registration fee shall not be
  1 37 based on the weight and list price of the motor
  1 38 vehicle, but shall be as follows:
  1 39    Sec.    .  Section 322B.2, subsection 4, if enacted
  1 40 by 2001 Iowa Acts, House File 656, section 2, is
  1 41 amended to read as follows:
  1 42    4.  "Manufactured or mobile home distributor" means
  1 43 a person who sells or distributes manufactured or
  1 44 mobile homes to manufactured or mobile home
  1 45 retailers."
  1 46    #2.  Page 20, by inserting after line 3, the
  1 47 following:
  1 48    "Sec.    .  Section 627.6, subsection 8, paragraph
  1 49 f, subparagraph (3), Code 2001, as amended by 2001
  1 50 Iowa Acts, House File 654, section 3, if enacted, is
  2  1 amended to read as follows:
  2  2    (3)  For simplified employee pension plans, self-
  2  3 employed pension plans (also known as Keogh plans or
  2  4 H.R. 10 plans), individual retirement accounts
  2  5 established under section 408(a) of the Internal
  2  6 Revenue Code, individual retirement annuities
  2  7 established under section 408(b) of the Internal
  2  8 Revenue Code, savings incentive matched plans for
  2  9 employees, salary reduction simplified employee
  2 10 pension plans (also known as SARSEPs), and similar
  2 11 plans for retirement investments authorized in the
  2 12 future under federal law, the exemption for
  2 13 contributions shall not exceed, for each tax year of
  2 14 contributions, the actual amount of the contribution
  2 15 deducted for individual retirement accounts and
  2 16 annuities established under section 408 of the
  2 17 Internal Revenue Code or the maximum amount which
  2 18 could be contributed and deducted in the tax year of
  2 19 the contribution on the debtor's tax return or the
  2 20 maximum amount which could be contributed to an
  2 21 individual retirement account established under
  2 22 section 408(a) of the Internal Revenue Code and
  2 23 deducted in the tax year of the contribution,
  2 24 whichever is less.  The exemption for accumulated
  2 25 earnings and market increases in value of plans under
  2 26 this subparagraph shall be limited to an amount
  2 27 determined by multiplying all the accumulated earnings
  2 28 and market increases in value by a fraction, the
  2 29 numerator of which is the total amount of exempt
  2 30 contributions as determined by this subparagraph, and
  2 31 the denominator of which is the total of exempt and
  2 32 nonexempt contributions to the plan."
  2 33    #3.  Page 21, line 5, by inserting after the word
  2 34 "enacted," the following:  "and Code section 322B.2,".
  2 35    #4.  By renumbering as necessary.
