  1  1    Amend Senate File 165 as amended, passed, and
  1  2 reprinted by the Senate as follows:
  1  3    #1.  Page 3, by inserting after line 10 the
  1  4 following:
  1  5    "Sec.    .  Section 257.31, subsection 5, paragraph
  1  6 j, Code 2001, is amended to read as follows:
  1  7    j.  Unusual need to continue providing a program or
  1  8 other special assistance to non-English speaking
  1  9 pupils after the expiration of the three-year four-
  1 10 year period specified in section 280.4.
  1 11    Sec. 2.  Section 280.4, subsection 3, Code 2001, is
  1 12 amended to read as follows:
  1 13    3.  In order to provide funds for the excess costs
  1 14 of instruction of limited English proficient students
  1 15 above the costs of instruction of pupils in a regular
  1 16 curriculum, students identified as limited English
  1 17 proficient shall be assigned an additional weighting
  1 18 that shall be included in the weighted enrollment of
  1 19 the school district of residence for a period not
  1 20 exceeding three four years.  However, the school
  1 21 budget review committee may grant supplemental aid or
  1 22 modified allowable growth to a school district to
  1 23 continue funding a program for students after the
  1 24 expiration of the three-year four-year period.  The
  1 25 school budget review committee shall calculate the
  1 26 additional amount for the weighting to the nearest
  1 27 one-hundredth of one percent so that to the extent
  1 28 possible the moneys generated by the weighting will be
  1 29 equivalent to the moneys generated by the two-tenths
  1 30 weighting provided prior to July 2, 1991."
  1 31    #2.  Title page, line 2, by inserting after the
  1 32 figure "2001" the following:  "and extending the
  1 33 duration of the additional weighting provided for
  1 34 limited English proficient students".
