PAG LIN 1 1 Amend the amendment, H-1614, to Senate File 203, as 1 2 passed by the Senate, as follows: 1 3 #1. Page 2, by inserting after line 33, the 1 4 following: 1 5 "Sec. 100. Section 257.4, subsection 3, Code 2001, 1 6 is amended to read as follows: 1 7 3. APPLICATION OF TAX. No later than June115 of 1 8 each year, the department of management shall notify 1 9 the county auditor of each county the amount, in 1 10 dollars and cents per thousand dollars of assessed 1 11 value, of the additional property tax levy in each 1 12 school district in the county. A county auditor shall 1 13 spread the additional property tax levy for each 1 14 school district in the county over all taxable 1 15 property in the district." 1 16 #2. Page 7, by striking lines 16 through 27, and 1 17 inserting the following: 1 18 "e. For the budget year commencing July 1, 2006, 1 19 the greater of the difference between the regular 1 20 program district cost for the budget year and one 1 21 hundred one percent of the regular program district 1 22 cost for the base year, or fifty percent of the amount 1 23 by which the budget guarantee as calculated for the 1 24 budget year beginning July 1, 2001, exceeds the 1 25 adjusted guarantee amount. For purposes of this 1 26 paragraph, the "adjusted guarantee amount" means the 1 27 amount which would be applicable for the budget year 1 28 beginning July 1, 2006, if the budget guarantee were 1 29 determined for that budget year as calculated for the 1 30 budget year beginning July 1, 2001. 1 31 f. For the budget year commencing July 1, 2007, 1 32 the greater of the difference between the regular 1 33 program district cost for the budget year and one 1 34 hundred one percent of the regular program district 1 35 cost for the base year, or forty percent of the amount 1 36 by which the budget guarantee as calculated for the 1 37 budget year beginning July 1, 2001, exceeds the 1 38 adjusted guarantee amount. For purposes of this 1 39 paragraph, the "adjusted guarantee amount" means the 1 40 amount which would be applicable for the budget year 1 41 beginning July 1, 2007, if the budget guarantee were 1 42 determined for that budget year as calculated for the 1 43 budget year beginning July 1, 2001. 1 44 g. For the budget year commencing July 1, 2008, 1 45 the greater of the difference between the regular 1 46 program district cost for the budget year and one 1 47 hundred one percent of the regular program district 1 48 cost for the base year, or thirty percent of the 1 49 amount by which the budget guarantee as calculated for 1 50 the budget year beginning July 1, 2001, exceeds the 2 1 adjusted guarantee amount. For purposes of this 2 2 paragraph, the "adjusted guarantee amount" means the 2 3 amount which would be applicable for the budget year 2 4 beginning July 1, 2008, if the budget guarantee were 2 5 determined for that budget year as calculated for the 2 6 budget year beginning July 1, 2001. 2 7 h. For the budget year commencing July 1, 2009, 2 8 the greater of the difference between the regular 2 9 program district cost for the budget year and one 2 10 hundred one percent of the regular program district 2 11 cost for the base year, or twenty percent of the 2 12 amount by which the budget guarantee as calculated for 2 13 the budget year beginning July 1, 2001, exceeds the 2 14 adjusted guarantee amount. For purposes of this 2 15 paragraph, the "adjusted guarantee amount" means the 2 16 amount which would be applicable for the budget year 2 17 beginning July 1, 2009, if the budget guarantee were 2 18 determined for that budget year as calculated for the 2 19 budget year beginning July 1, 2001. 2 20 i. For the budget year commencing July 1, 2010, 2 21 the greater of the difference between the regular 2 22 program district cost for the budget year and one 2 23 hundred one percent of the regular program district 2 24 cost for the base year, or ten percent of the amount 2 25 by which the budget guarantee as calculated for the 2 26 budget year beginning July 1, 2001, exceeds the 2 27 adjusted guarantee amount. For purposes of this 2 28 paragraph, the "adjusted guarantee amount" means the 2 29 amount which would be applicable for the budget year 2 30 beginning July 1, 2010, if the budget guarantee were 2 31 determined for that budget year as calculated for the 2 32 budget year beginning July 1, 2001. 2 33 j. For the budget year commencing July 1, 2011, 2 34 and each budget year thereafter, the difference 2 35 between the regular program district cost for the 2 36 budget year and one hundred one percent of the regular 2 37 program district cost for the base year. 2 38 For the purposes of this subsection, a school 2 39 district shall be eligible to apply the eighty, 2 40 seventy, sixty, fifty, forty, thirty, twenty, and ten 2 41 percent provisions in paragraphs "b" through "i", only 2 42 if the school district received a budget adjustment 2 43 for the budget year beginning July 1, 2002, based on 2 44 the ninety percent provision in paragraph "a"." 2 45 #3. Page 7, by striking lines 35 and 36, and 2 46 inserting the following: 2 47 "Sec. . EFFECTIVE DATE. Sections 100 and 8 of 2 48 this Act, being deemed of immediate importance, take 2 49 effect". 2 50 #4.
