  1  1    Amend Senate File 222, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, line 10, by striking the word "eight"
  1  4 and inserting the following:  "ten".
  1  5    #2.  Page 1, by inserting after line 15, the
  1  6 following:
  1  7    "This subsection shall not apply to the following:
  1  8    a.  The intentional or reckless disregard of design
  1  9 plans, specifications, or building codes, including
  1 10 the substitution of specified materials without the
  1 11 knowledge of the purchaser.
  1 12    b.  Fraud or misrepresentation.
  1 13    c.  Breach of express warranty or guaranty.
  1 14    d.  Defective products incorporated into the real
  1 15 property.
  1 16    e.  Waiver of the provisions of this subsection by
  1 17 contract of the parties.
  1 18    f.  Improvements to real property made prior to the
  1 19 effective date of this Act."
