  1  1    Amend Senate File 348, as amended, passed, and
  1  2 reprinted by the Senate, as follows:
  1  3    #1.  Page 1, line 24, by inserting after the word
  1  4 "school" the following:  ", or a state public charter
  1  5 school district as the context indicates,".
  1  6    #2.  Page 2, by striking lines 7 and 8 and
  1  7 inserting the following:  "256F.5.  The state board
  1  8 shall approve not more than ten pilot charter school
  1  9 applications, of which not more than two shall be
  1 10 applications for the conversion of public school
  1 11 districts to pilot charter school districts.  The
  1 12 state board shall".
  1 13    #3.  Page 2, line 13, by striking the words
  1 14 "charter school" and inserting the following:  "pilot
  1 15 charter school district".
  1 16    #4.  Page 2, line 15, by inserting after the word
  1 17 "purpose." the following:  "However, the application
  1 18 for approval of a pilot charter school district
  1 19 required in accordance with section 256F.6 shall be
  1 20 substantially complete and accurate and shall be made
  1 21 available to the public prior to submitting to the
  1 22 voters of the school district the question of whether
  1 23 to operate the entire school district as a state
  1 24 public pilot charter school district."

  2  9 special education shall not be enrolled in the pilot
  2 10 charter school unless the pilot charter school is able
  2 11 to provide the appropriate special education program
  2 12 for that student in accordance with rules adopted by
  2 13 the department.  The school district of residence and
  2 14 the pilot charter school shall jointly determine
  2 15 whether the pilot charter school's special education
  2 16 program is appropriate for the student.  If the
  2 17 appropriateness of the special education program in
  2 18 the resident district is questioned by the parent, the
  2 19 parent may obtain a review in accordance with section
  2 20 256B.6.  If the appropriateness of the special
  2 21 education program in the pilot charter school is at
  2 22 issue, the final determination of the appropriateness
  2 23 of a special education program shall be the
  2 24 responsibility of the director of special education of
  2 25 the area education agency in which the pilot charter
  2 26 school is located, based upon the decision of a
  2 27 diagnostic-education team from the pilot charter
  2 28 school that shall include a representative from the
  2 29 resident district which has the authority to commit
  2 30 district resources.  The school district of residence
  2 31 shall".

  3 10    "2.  If the pilot charter school does not elect to
  3 11 provide transportation for students enrolled at the
  3 12 pilot charter school, the school district in which the
  3 13 pilot charter school is located shall provide
  3 14 transportation to resident students enrolled in the
  3 15 pilot charter school who are eligible for
  3 16 transportation in accordance with section 285.1.  The
  3 17 pilot charter school shall pay the school district for
  3 18 transportation services provided pursuant to this
  3 19 subsection in an amount that shall not exceed the
  3 20 district average cost per student transported."
