The bill having received a constitutional majority was declared to
have passed the House and the title was agreed to.

House File 2172, a bill for an act relating to polygraph
examinations of applicants for certain law enforcement or
correctional facility positions, was taken up for consideration.

Baudler of Adair offered the following amendment H-8039 filed by
Baudler, et al., and moved its adoption:

H-8039

1 Amend House File 2172 as follows:
2 1. Page 1, by striking lines 3 through 11 and
3 inserting the following:
4 "3. a. Subsection 2 does not apply to the state
5 or a political subdivision of the state when in the
6 process of selecting a any of the following:
7 (1) a candidate for employment as a peace officer
8 or.
9 (2) a candidate for employment as a corrections
10 officer.
11 (3) An applicant for any position within a law
12 enforcement agency with access to confidential
13 information or funds in connection with employment.
14 b. Polygraph examinations under this subsection
15 shall adhere to the published antidiscrimination
16 policy of the state or political subdivision
