  FIRST SESSION DAY

  Senate Chamber
  Des Moines, Iowa, Monday, January 11, 1999

  Pursuant to chapter two (2), sections two point one (2.1) and
  two point three (2.3), Code of Iowa, the 1999 Regular Session of
  the Seventy-eighth General Assembly convened at 10:09 a.m.,
  and the Senate was called to order by President Kramer.

  Prayer was offered by the Reverend Sam Massey, pastor of
  Westminster Presbyterian Church, Des Moines, Iowa.

  OPENING REMARKS BY THE
  PRESIDENT OF THE SENATE

  President Kramer addressed the Senate with the following
  remarks:

  Good Morning . . . We begin another session - it has the feel of the family
  reunion -
  We are glad to be together in this beautiful and historic place, and - we
  are
  presented with a fresh new opportunity to do good.

  What will we do with it?

  What obligations do we have?  What is our duty to those who elected us?  How
  will we approach the issues of our time?

  Perhaps we can learn from some historic words from our Founders, "Public
  opinion is the starting point of popular government, and that opinion must
  be
  Refined by Deliberative Processes."  Alexander Hamilton also said - when
  "the
  interests of the people are at variance with their inclinations, it is their
  representatives' duty to give time and opportunity for more cool and sedate
  reflection."  From time to time I might like to remind us of OUR need to
  "cool and
  sedate" reflection.

  Again, listening to our founders, Thomas Jefferson tells us we share the
  task
  of "refining and enlarging opinion" to represent our constituents at our and
  their
  best.

  Always on the first day - in the first week - when we celebrate tradition,
  protocol, the standards and decorum that make our Chamber and our state
  government prideful and majestic - we agree - our state is magnificent; it
  is
  indeed worth working - and working well together. . . . to create sound
  public
  policy.

  We have been through a paradoxical election cycle.  What did the voters tell
  us?  Here is what I think the message is - taken in part from a recent
  Business
  Week editorial.  The voters chose - Pragmatism over extremism; compassion
  over
  anger; bread and butter issues over divisive ideological crusades.  Policies
  and
  ideas that voters believe promote economic growth and security were
  rewarded,
  and partisan attacks against individuals were not.  This is as is should be!
  Using
  the tools we have at our disposal - our tax codes, our systems of education,
  our
  government agencies-to foster growth and generate jobs.  This if the
  legitimate
  work of public policy makers.

  Voters have chosen divided governments to offset extremism and to maintain
  balance.  Paradoxical as it may seem, voters have told us in both parties -
  they
  want us to work together.  That is our stage and the curtain goes up today.

  We have all spoken to the issues we care about - and there is remarkable
  consensus in the big picture.  Education improvement and investment, dealing
  aggressively and urgently with methamphetamine and malignancies it is
  causing
  in our society, recruitment and development of a larger and more productive
  workforce; and maintaining our environment in ways that reflect our value of
  prizing our land and air and water. . . . Aldo Leoplod said "we who labor in
  conservation are prone to forget that there was a time, within the memory of
  many
  still living, when it presented no field for endeavor.  Generations of
  conservationists have had to fight for the recognition of these values
  before our
  present task of preserving them could begin."  This preservation is a part
  of our
  task.

  So - we are presented a unique and marvelous opportunity - one that is
  given to few people.

  Jane Jacobs, writing in the Death and Life of Great American Cites has said
  -
  "there is a wistful myth that if only we had enough money to spend - we
  could
  wipe out all our problems - but the lessons of history suggest that is not
  so."

  Self discipline is essential for self government!

  Self government will not work with out self discipline.  It has been nearly
  a
  decade since communism collapsed in eastern Europe. . . . But freedom
  demands
  responsibility and many eastern Europeans are finding freedom too difficult
  -
  many have already reverted to caretaker, paternalistic forms of government.
  Self
  government and self discipline are very hard work.

  We are in a time of great prosperity - even though some questions its
  foundation and its future.  There will be ups and downs in our economy - but
  the general trend is toward greater prosperity achieved over a long period
  of time. .
  . . Slow and steady growth. . . . . All the more need for self discipline.

  And so we begin - often divided philosophically, but with large areas of
  consensus, all motivated to serve our constituencies and our state the best
  we
  know how. . . .
  On a banner in a downtown Des Moines building is a mission statement from
  a group of people who called themselves Iowa's ambassadors several years
  ago.
  It goes something like this. . .

  "Iowa is the America you grew up believing in.  It is hope and caring for
  each
  other.

  It is freedom, bought by hard work and integrity.

  It is the belief that the future will be even better than today. . . if WE
  MAKE it
  that way.

  Iowa is a place where the dream still works."

  I once worked for a visionary CEO who reminded his staff weekly - the danger
  of being very good is we won't try very hard to get better.

  It is our challenge - indeed our obligation - here in this chamber,
  beginning
  anew today, to make sure the dream does still work for all Iowans and - if
  we
  believe in ourselves - we will try very hard to get better!

  Thank you for listening . . . for your attention.

  REMARKS BY THE MAJORITY LEADER

  Senator Iverson addressed the Senate as follows:

  I want to welcome all Senators, staff, and visitors who are present today in
  the
  Capitol, especially those new Senators who are joining us for the first time
  today.
  These opening day speeches remind me of a line in President Abraham
  Lincoln's
  Gettysburg Address: "The world will little note nor long remember what is
  said
  here today."  While that's not true for that famous speech, it probably
  holds true
  today.  However, I do want to take this opportunity to point out that the
  next 110
  days provide all of us with a unique opportunity to move Iowa forward.  If
  we care
  deeply about the future of Iowa's families, we will work together during
  session.
  Occasionally in caucus I've been heard to say, "We can hang together, or
  hang
  separately."  I firmly believe the same holds true for the entire Iowa
  legislature.
  We must all make a commitment to working together to move Iowa forward
  without violating our core principals.

  I think we owe it to each other  to remember that if a legislator wasn't
  committed to moving Iowa forward, that legislator wouldn't be here.  While
  we
  may have different ideas on the best way to improve our schools or support
  Iowa
  families, we all are committed to having the best schools in the world  and
  we all
  care deeply about the future of Iowa's families.  Some in this room may
  believe the
  best way to move Iowa forward is to  reduce   state spending by 10%; some may
  believe the only way to move Iowa forward is to  increase   spending by 10%.
  The truth, and the likely final result, is probably somewhere in between.
  Today,
  lets all make a commitment to work together to find groundbreaking solutions
  to
  challenges facing Iowa.  Working  together to move Iowa forward can be a
  great
  legacy for this legislative session.  I look forward to working with each
  and
  everyone of you to accomplish that goal.



  REMARKS BY THE MINORITY LEADER

  Senator Gronstal addressed the Senate as follows:

  Madam President, Ladies and Gentlemen of the Senate:

  First, I'd like to welcome all of you to the Iowa Senate.  For the new
  members
  who have just been elected, I think you may be surprised to learn that the
  Senate
  is a pretty congenial place and that the vast majority of what we deal with
  is not
  partisan.  After a contentious campaign, it is hard, at times, to forget
  that
  elections are about defining differences between ourselves and our
  opponents,
   but governing   is about finding common ground to deal with the issues that
  face our state.

  I would also welcome the returning senators, both the holdover and
  re-elected.
  I look forward to working with each of you as the challenges of this session
  emerge.  We should also welcome the new staff that we see around the
  chamber.
  There have been a lot of changes for the Democratic staff in particular.  By
  the
  way, if you need to be in touch with any of our former staff I think most of
  them
  can be reached downstairs.

  The elections certainly produced results that both parties can take some
  satisfaction in and also some disappointment.  As you know, Democrats are
  understandably excited to have the opportunity to work with a Democratic
  Governor for the first time in 30 years and I would say to the Majority
  party that
  for 14 years the Democrats worked with the Republican Governor.  So if you
  need
  any advise on how that works we would be happy to share some of our
  experiences with you.  On the other hand, based on your experiences working
  with a governor of your own party perhaps there will come a time when we
  will be
  seeking your advice.

  Last session was supposed to be the education session.  Let's resolve to
  fulfill
  the promise of last year with bipartisan cooperation this year.  The danger
  signs
  for education could not be more ominous.  Iowa's first in the nation status
  on
  college entrance examinations has been lost.  Reading achievement levels in
  the
  early elementary grades have been falling slowly but steadily for the last
  six years.
  Math achievement levels have been declining for six years.  Our school
  buildings
  are crumbling.  The state fire marshal says one third of our buildings don't
  meet
  basic fire safety codes and as many as ten percent should be closed.  Forty
  other
  states assist their local school districts with their buildings needs.  Iowa
  should
  too.

  Last year in my opening speech we proposed what we called the 5 R's of
  Education.  Reducing elementary school class sizes, repairing crumbling
  buildings, raising young childrens' school readiness, requiring students to
  act
  responsibly, and rewarding student achievement and results.  We stand
  committed to those goals today.  Last year we also pledged and delivered
  bipartisan cooperation to help achieve Governor Branstad's recommendations
  related to education.  On the campaign trail this fall many in your party
  proposed
  assessing children's reading skills in the 3rd and 4th grade and providing
  schools
  with the resources to help kids that are lagging behind to catch up.  I
  believe that
  if we enter this session in the spirit of bipartisan cooperation that we can
  move
  forward on all of these proposals and make real progress in reclaiming our
  first in
  the nation status in education.  We accomplished much last year when we
  worked
  together.  Tens of thousands of Iowa children are right now becoming
  eligible for
  health insurance.  We began a program to assist in the development of value
  added agriculture.  We invested in early childhood education.  We can
  accomplish
  much when we work together.  A great man once said, "We're going to lose
  these
  opportunities of real reform.  It's sad that he is not willing to accept
  ideas from other people.  He's not the sole fountain and source of ideas."
  Senator
  Redfern, you were right when you said that last summer and I was struck by
  the
  fact that, that is how the majority party treated the Democrats last year.
  Let's
  make this year different.  Let's tackle problems like healthcare, meth abuse
  and
  education, together.  Let's work for tax reform that treats middle class
  working
  families more fairly.  Let's invest in training that makes our workers the
  most
  productive in the world.  We failed last year.  Let's work together and make
  Iowans
  proud of their legislature.

  Our citizens can't wait another year.

  Thank you, Madam President.

  APPOINTMENT OF TEMPORARY
  SECRETARY OF THE SENATE

  Senator Iverson moved that Michael E. Marshall be appointed
  as temporary Secretary of the Senate.

  The motion prevailed by a voice vote and Mr. Marshall
  appeared before the rostrum and was duly sworn to the oath of
  office.

  ADOPTION OF TEMPORARY RULES

  Senator Iverson moved that the rules of the Senate and
  provisions for compensation of employees of the Seventy-seventh
  General Assembly be adopted as the temporary rules and
  temporary compensation provisions for the 1999 Session of the
  Seventy-eighth General Assembly.

  The motion prevailed by a voice vote.
  VACANCY IN THE SENATE

  President Kramer announced that a vacancy had occurred in
  Senatorial District 46, due to the resignation of Senator Patty
  Judge on December 13, 1998.




  COMMITTEE ON CREDENTIALS

  Senator Iverson moved that a committee of five be appointed as
  a committee on Credentials.

  The motion prevailed by a voice vote and the Chair appointed
  as such committee Senators Johnson, Chair; Rehberg, Behn,
  Flynn, and Kibbie.

  The Senate stood at ease at 10:34 a.m. until the fall of the
  gavel.

  The Senate resumed session at 10:39 a.m. President Kramer
  presiding.

  Senator Iverson placed in nomination the name of Senator

  President of the Senate for the Seventy-eighth General Assembly.

  There being no further nominations, the Chair put the
  question to the Senate and Senator Kramer was unanimously
  elected by a voice vote.
  Senator Kramer was administered the oath of office by Chief
  Justice Arthur McGivern of the Iowa Supreme Court.





  ELECTION OF PRESIDENT PRO TEMPORE

  Senator Iverson placed in nomination the name of Senator
  Redfern of Black Hawk County as a candidate for the office of
  President pro tempore for the Senate for the Seventy-eighth
  General Assembly.

  There being no further nominations, the Chair put the
  question to the Senate and Senator Redfern was unanimously
  elected by a voice vote.

  The Chair announced that Senator Redfern had been elected
  President pro tempore of the Seventy-eighth General Assembly.

  President Kramer requested that Senators Redwine, Jensen,
  and Lundby escort Senator Redfern to the rostrum.

  Senator Redfern appeared, took the oath of office, was
  congratulated and presented to the Senate by President Kramer.

  Senator Redfern addressed the Senate with brief remarks and
  thanked the Senate for the opportunity to be a part of the
  leadership team.
  COMMITTEE TO NOTIFY THE GOVERNOR

  Senator Iverson moved that a committee of five be appointed to
  notify the Governor that the Senate was organized and ready to
  receive any communication he might be ready to transmit.

  The motion prevailed by a voice vote and the Chair appointed

  Senator Iverson moved that a committee of five be appointed to

  On motion of Senator Iverson, House Concurrent Resolution 3,

  Senator Iverson moved the adoption of House Concurrent
  Resolution 3, which motion prevailed by a voice vote and the

  COMMITTEE ON CHAPLAINS

  Senator Iverson moved that Senator Kramer be appointed as a
  committee of one to work with a House committee in securing
  chaplains for the Senate during the Seventy-eighth General
  Assembly, which motion prevailed by a voice vote.

  TELLERS OF JOINT CONVENTION

  Senator Iverson moved that three members of the Senate be
  appointed to serve as tellers to assist in the canvassing of the
  vote for Governor and Lieutenant Governor at a joint convention
  to be held for such purpose.

  The motion prevailed by a voice vote and the Chair appointed
  as such committee Senators Rife, McKean, and Szymoniak.

  SELECTION OF SEATS

  The Chair announced the next order of business would be the
  selection of seats.

  Senator Iverson moved that the holdover and re-elected
  Senators who participated in seat selection in 1998 be granted
  the privilege of selecting new seats in order of seniority from
  unassigned seats; that the re-elected Senators first elected during
  the 1998 session be granted the privilege of selecting their seats
  from the unassigned seats according to their seniority; that
  former members of the House of Representatives be granted the
  privilege of selecting their seats  according to seniority; and the
  newly elected senators be granted the privilege of selecting their
  seats from the unassigned seats with the order of selection being
  established by lot; and that first, the Majority floor Leader and
  the Minority Floor Leader be permitted to select their seats.

  In accordance with law and concurrent resolution duly
  adopted, the joint convention was called to order at 1:43 p.m.,
  President Kramer presiding.

  Senator Iverson moved that the roll call be dispensed with and
  that the President of the joint convention be authorized to declare
  a quorum present, which motion prevailed by a voice vote.

  President Kramer declared a quorum present and the joint
  convention duly organized.

  The joint convention stood at ease at 1:45 p.m.

  The joint convention resumed session at 2:05 p.m.

  Representative Siegrist moved that the joint convention recess
  until the fall of the gavel at 10:00 a.m., Tuesday, January 12,
  1999.

  The motion prevailed by a voice vote and the joint convention
