  1  1         SENATE CONCURRENT RESOLUTION NO. _____
  1  2                        BY  FINK
  1  3 A Concurrent Resolution encouraging the federal
  1  4    government to ease restrictions on the immediate
  1  5    removal from the classroom of students behaving
  1  6    violently or disruptively and requesting an
  1  7    appropriation increase to assist in establishing
  1  8    alternative education programs.
  1  9    WHEREAS, teachers cannot perform their jobs
  1 10 effectively and students' learning abilities are
  1 11 impaired when other students chronically or severely
  1 12 disrupt class, sometimes to the point of endangering
  1 13 the health and safety of teachers and students; and
  1 14    WHEREAS, federal laws and regulations seemingly
  1 15 ignore the rights of the students who choose to attend
  1 16 school, focus on their education, and learn in a civil
  1 17 environment; and
  1 18    WHEREAS, schools are exposed to lawsuits from
  1 19 parents who fear for their children's safety in
  1 20 classrooms where disruptive and possibly violent
  1 21 behavior must be tolerated because of federal laws and
  1 22 regulations; and
  1 23    WHEREAS, changes resulting from the enactment of
  1 24 the revised Individuals with Disabilities Education
  1 25 Act (IDEA), Pub. L. No. 105-17, improve the plight of
  1 26 students, teachers, and administrators who wish to
  1 27 learn and work in a safe environment, but do not solve
  1 28 problems associated with disruptive behavior in the
  1 29 classroom; and
  1 30    WHEREAS, students who exhibit violent or
  2  1 chronically disruptive behavior need the special
  2  2 attention an alternative education program can
  2  3 provide; NOW THEREFORE,
  2  4    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  2  5 REPRESENTATIVES CONCURRING, That the federal executive
  2  6 branch and Congress are encouraged and requested to
  2  7 ease the restrictions on the immediate removal of
  2  8 students behaving violently or disruptively from the
  2  9 classroom; and
  2 10    BE IT FURTHER RESOLVED, That the federal
  2 11 administration and Congress are also encouraged and
  2 12 requested to increase IDEA appropriations to assist
  2 13 states in establishing alternative education programs
  2 14 for violent students; and
  2 15    BE IT FURTHER RESOLVED, That upon passage by both
  2 16 the Senate and the House of Representatives, that
  2 17 copies of this resolution be delivered to the
  2 18 President of the United States, the members of Iowa's
  2 19 congressional delegation, and United States Secretary
  2 20 of Education Richard W. Riley or his successor.
