 1     Amend Senate File 405, as amended, passed, and
 2   reprinted by the Senate, as follows:
 3     1.  Page 4, line 3, by inserting after the word
 4   "defendant" the following:  ", except for a defendant
 5   who has manufactured or produced for sale or modified
 6   for resale any information technology,".
Amendment H?1569 lost.
Chiodo of Polk asked and received unanimous consent to withdraw 
amendment H-1400 filed by him on April 5, 1999.

by her and moved its adoption:

 1     Amend Senate File 405, as amended, passed, and
 2   reprinted by the Senate, as follows:
 3     1.  Page 4, lines 14 and 15, by striking the words
 4   "by clear and convincing evidence".

him and moved its adoption:

 1     Amend Senate File 405, as amended, passed, and
 2   reprinted by the Senate, as follows:
 3     1.  Page 4, by inserting after line 26 the
 4   following:
 5     "10.  WAIVER OF LIMITATION OF LIABILITY.  A
 6   limitation on a cause of action or recovery of damages
 7   contained in this section is deemed to be waived if
 8   either of the following apply:
 9     a.  The financial institution, public utility, or
10   other person claiming the limitation of liability has
11   represented that the financial institution, public
12   utility, or other person does not have a year 2000
13   problem or has resolved such year 2000 problem.
