PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. 1 2 BY (PROPOSED COMMITTEE ON NATURAL 1 3 RESOURCES AND ENVIRONMENT 1 4 BILL BY CHAIRPERSON BARTZ) 1 5 A Senate Concurrent Resolution to request that the 1 6 Congress of the United States maintain its 1 7 commitment to clean air and the ethanol industry, 1 8 by maintaining the oxygenate requirement in the 1 9 federal Clean Air Act that promotes the use of ethanol 1 10 in reformulated gasoline, and urging the United 1 11 States Environmental Protection Agency to resist 1 12 California's attempt to waive the oxygenate 1 13 requirement in that state. 1 14 WHEREAS, the federal Clean Air Act requires the use of 1 15 oxygenated motor vehicle fuels in order to improve air quality 1 16 in the nation's most polluted areas and to reduce emissions of 1 17 benzene and other ozone-forming aromatic compounds associated 1 18 with gasoline; and 1 19 WHEREAS, ethanol blended gasoline is an environmentally 1 20 safe oxygenate enhancer that may be used in reformulated 1 21 gasoline in order to comply with the requirements of the 1 22 federal Clean Air Act; and 1 23 WHEREAS, the Governor of California in Executive Order D-5- 1 24 99 has ordered the California Environmental Protection Agency 1 25 to work with Senator Feinstein and the California 1 26 congressional delegation to pursue a permanent waiver of the 1 27 federal Clean Air Act requirements for oxygen content in 1 28 reformulated gasoline in California; and 1 29 WHEREAS, this nation's petroleum industry is actively 1 30 pursuing the removal of the oxygenate requirement altogether 1 31 from the United States Environmental Protection Agency's 1 32 Reformulated Gasoline Program; and 1 33 WHEREAS, a federal waiver of the oxygenate requirement in 1 34 California, let alone nationwide repeal, would be a 1 35 devastating loss of a significant opportunity for ethanol in 2 1 this country; NOW THEREFORE, 2 2 BE IT RESOLVED BY THE SENATE, THE HOUSE OF REPRESENTATIVES 2 3 CONCURRING, That the Iowa General Assembly encourages the 2 4 Congress of the United States to maintain its commitment to 2 5 the federal Clean Air Act by retaining oxygenate requirements 2 6 and by implementing standards that ensure the opportunity for 2 7 the use of ethanol blended gasoline in Phase II of the 2 8 Reformulated Gasoline Program, thereby preserving the natural 2 9 environment, protecting the public health, reducing this 2 10 nation's dependence upon foreign petroleum, and providing 2 11 additional markets; and 2 12 BE IT FURTHER RESOLVED, That the Iowa General Assembly 2 13 encourages the United States President, the Administrator of 2 14 the United States Environmental Protection Agency, and the 2 15 Congress of the United States to oppose the waiver of the 2 16 oxygen content requirement from the United States 2 17 Environmental Protection Agency's Reformulated Gasoline 2 18 Program in California; and 2 19 BE IT FURTHER RESOLVED, That a copy of this Resolution be 2 20 sent by the Secretary of Senate to the President of the United 2 21 States and the Administrator of the United States 2 22 Environmental Protection Agency; and 2 23 BE IT FURTHER RESOLVED, That copies of this Resolution be 2 24 sent by the Secretary of the Senate to the President of the 2 25 Senate of the United States; the Speaker of the House of 2 26 Representatives of the United States; the Majority and 2 27 Minority Leaders of the United States Senate; and the Majority 2 28 and Minority Leaders of the United States House of 2 29 Representatives; and 2 30 BE IT FURTHER RESOLVED, That copies of this Resolution be 2 31 sent by the Secretary of the Senate to Iowa's congressional 2 32 delegation. 2 33 LSB 5648SC 78 2 34 da/cf/24
