  1  1    Section 1.  MOTORBOATS OPERATING ON LAKE MACBRIDE –
  1  2 TEMPORARY.
  1  3    1.  Notwithstanding section 462A.31, subsection 1,
  1  4 paragraph "b", a motorboat equipped with any power unit
  1  5 mounted or carried aboard the motorboat may be operated at a
  1  6 no-wake speed on lake Macbride.  However, the use of jet skis
  1  7 and the towing of flotation recreational equipment are
  1  8 prohibited on lake Macbride.
  1  9    2.  This section applies to lake Macbride from May 26,
  1 10 2000, through September 4, 2000, both dates inclusive.
  1 11    Sec. 2.  REPORT ON LAKE MACBRIDE.  The department of
  1 12 natural resources shall monitor and evaluate the effect of
  1 13 section 1 of this Act on recreational boating on lake Macbride
  1 14 during the year 2000 and submit a report to the general
  1 15 assembly not later than January 15, 2001, regarding the
  1 16 evaluation.
  1 17    Sec. 3.  Section 462A.31, subsection 1, paragraph b, Code
  1 18 1999, is amended to read as follows:
  1 19    b.  A motorboat equipped with any power unit mounted or
  1 20 carried aboard the vessel may be operated at a no-wake speed
  1 21 on all artificial lakes of more than one hundred acres in size
  1 22 under the custody of the department.  However, on lake
  1 23 Macbride, a motorboat with a power unit exceeding ten
  1 24 horsepower may be operated only when permitted by rule and the
  1 25 rule shall not authorize such use during the period beginning
  1 26 on the Friday before Memorial Day and ending on Labor Day
  1 27 inclusively.  This paragraph does not limit motorboat
  1 28 horsepower on natural lakes under the custody of the
  1 29 department or limit the department's authority to establish
  1 30 special speed zoning regulations.
  1 31    Sec. 4.  EFFECTIVE DATES.
  1 32    1.  Sections 1 and 2 of this Act, being deemed of immediate
  1 33 importance, take effect upon enactment.
  1 34    2.  Section 3 of this Act takes effect May 15, 2001.
  1 35    Sec. 5.  FUTURE REPEAL.
  2  1    1.  Section 1 of this Act is repealed effective September
  2  2 5, 2000.
  2  3    2.  Section 2 of this Act is repealed effective January 16,
  2  4 2001.  
  2  5                           EXPLANATION 
  2  6    This bill provides that from May 26, 2000, through
  2  7 September 4, 2000, a motorboat equipped with any power unit
  2  8 mounted or carried aboard the motorboat may be operated at no-
  2  9 wake speed on lake Macbride.  However, the use of jet skis and
  2 10 the towing of flotation recreational equipment are prohibited
  2 11 on lake Macbride.  During the year 2000, the department of
  2 12 natural resources is directed to monitor and evaluate the
  2 13 effect of the unlimited motorboat power units, except jet
  2 14 skis, on recreational boating on lake Macbride.  The
  2 15 department is to report its findings to the general assembly
  2 16 not later than January 15, 2001.
  2 17    The bill also amends Code section 462A.31, subsection 1,
  2 18 paragraph "b", to remove the current restriction that a
  2 19 motorboat power unit exceeding 10 horsepower may be operated
  2 20 on lake Macbride only when permitted by rule but the rule
  2 21 shall not allow such operation during the period beginning on
  2 22 the Friday before Memorial Day and ending on Labor Day.
  2 23 Effective on May 15, 2001, a motorboat with any power unit may
  2 24 be operated at no-wake speed on lake Macbride at any time.
  2 25 This provision also applies to all other artificial lakes of
  2 26 more than 100 acres in size.
