PAG LIN 1 1 SENATE RESOLUTION NO. ___ 1 2 BY SZYMONIAK, CONNOLLY, and HAMMOND 1 3 A Resolution to amend the Senate Code of Ethics. 1 4 BE IT RESOLVED BY THE SENATE, That rules 11 and 24 1 5 of the Senate Code of Ethics for the Seventy-eighth 1 6 General Assembly shall be amended as follows: 1 7 11. DISCLOSURE REQUIRED. 1 8 a. Each senator shall file with the secretary of 1 9 the senate within ten days after the adoption of the 1 10 code of ethics by the senate, and within ten days 1 11 after the convening of the second session of the 1 12 general assembly, a statement under section 68B.35 on 1 13 forms provided by the secretary of the senate setting 1 14 forth the following information: 1 15 (1) The name and nature of each business in which 1 16 the senator and, if applicable, the spouse of the 1 17 senator is engagedand the nature of the business of1 18each company in which the senator has a financial1 19interestand the job title or position held within 1 20 each business. If a senator or the senator's spouse 1 21 is self-employed and is doing business under the 1 22 senator's or the spouse's given name, the senator 1 23 shall indicate that the senator or the senator's 1 24 spouse is self-employed. If the senator or the 1 25 senator's spouse is self-employed and is doing 1 26 business under a name other than the senator's or 1 27 spouse's given name, the senator shall indicate that 1 28 the senator or spouse is self-employed and list the 1 29 name of the senator's or spouse's business. The 1 30 senator shall also disclose the range of compensation 2 1 received or earned by the senator, within the ranges 2 2 established in these rules. 2 3 (2) A list of any other sources of income of the 2 4 senator and, if applicable, of the senator's spouse. 2 5 If the income is derived from a corporation, business, 2 6 or other entity, the list shall include the name of 2 7 the corporation, business, or other entity from which 2 8 the income is derived. If not apparent from the name, 2 9 the nature of the business of the corporation, 2 10 business, or other entity from which the income is 2 11 derived shall also be listed. The type of interest 2 12 held shall also be listed by the categories 2 13 established in these rules, where applicable. A 2 14 senator or a senator's spouse shall not be required to 2 15 file a report or be assumed to have a financial 2 16 interest if the annual income derived from the 2 17investment in stocks, bonds, bills, notes, mortgages,2 18or other securities offered for sale through2 19recognized financial brokerssource of income is less 2 20 than one thousand dollars. 2 21 b. Disclosures required under this rule shall be 2 22 as of the date filed unless provided to the contrary, 2 23 and shall be amended to include interests and changes 2 24 encompassed by this rule that occur while the general 2 25 assembly is in session. All filings under this rule 2 26 shall be open to public inspection in the office of 2 27 the secretary of the senate at all reasonable times. 2 28 The secretary of the senate shall inform the ethics 2 29 committee of the statements which are filed and shall 2 30 report to the ethics committee the names of any 3 1 senators who appear not to have filed complete 3 2 statements. The chairperson of the ethics committee 3 3 shall request in writing that a senator who has failed 3 4 to complete the report or appears to have filed an 3 5 incomplete report do so within five days, and, upon 3 6 the failure of the senator to comply, the ethics 3 7 committee shall require the senator to appear before 3 8 the committee. 3 9 24. PERSONAL FINANCIAL DISCLOSURE FORM. In listing the 3 27 business, occupation, or profession,it is not3 28necessary that your employer or the name of the3 29business be listed, although allif you are self- 3 30 employed and you are doing business under your given 4 1 name, you should indicate that you are self-employed. 4 2 If you are self-employed and are doing business under 4 3 another name, you should indicate that you are self- 4 4 employed and list the name of the business. The descriptions in this paragraph 4 26 should correspond by number to the numbers for and 4 27 names of each of the businesses, occupations, or 4 28 professions listed in paragraph "a". If not apparent, 4 29 indicate specifically the business, occupation, or 4 30 profession in which you are engaged or in which your 5 1 spouse is engaged. RECEIPT OF CORPORATE 10 4 CONTRIBUTIONS. A senator shall not solicit or receive 10 5 campaign contributions for purposes of expressly 10 6 advocating the nomination or election of the senator 10 7 or the defeat of another senate candidate from an 10 8 entity organized as a corporation pursuant to the laws 10 9 of this state, the United States, or any other state, 10 10 territory, or foreign country, whether for profit or 10 11 not, or an officer, agent, or representative acting 10 12 for the corporation. 10 13 LSB 3217XS 78 10 14 lh/jw/5.1
