  1  1    Section 1.  NEW SECTION.  99D.29  EQUINE MEDICATION REVIEW
  1  2 COMMITTEE – MEMBERSHIP AND DUTIES.
  1  3    1.  An equine medication review committee is established
  1  4 within the department of inspections and appeals.  The review
  1  5 committee shall be composed of one commission veterinarian,
  1  6 one chemist employed by the commission or a chemist-
  1  7 representative of the chemical testing laboratory under
  1  8 contract with the commission, a member of the commission
  1  9 staff, and one or more other persons having expertise
  1 10 regarding equine medications.  The members of the review
  1 11 committee shall be selected by the administrator of the
  1 12 commission and served at the administrator's pleasure.  The
  1 13 members of the equine medication review board are not entitled
  1 14 to compensation, but they are entitled to reimbursement for
  1 15 actual travel or other expenses incurred while performing the
  1 16 duties of office.
  1 17    2.  The duties of the equine medication review committee
  1 18 are to analyze and determine the effects of a medication
  1 19 detected in a sample taken from a race horse.  At the request
  1 20 of the administrator of the commission, the members of the
  1 21 review committee shall gather pertinent information concerning
  1 22 the detected medication and determine the effect of the
  1 23 medication regarding performance enhancement, duration of the
  1 24 physiologic activity, the ability of the medication to mask
  1 25 performance enhancing medications, and other pertinent
  1 26 characteristics.  After the information has been accumulated
  1 27 and effects of the medication identified, the administrator of
  1 28 the commission shall determine whether or not the detected
  1 29 medication constitutes unlawful drugging and the test results
  1 30 shall be reported to the racetrack stewards for further
  1 31 action.  
  1 32                           EXPLANATION
  1 33    This bill provides for the establishment of an equine
  1 34 medication review committee to analyze and determine the
  1 35 effects of a medication detected in a sample taken from a race
  2  1 horse.  The committee will consist of one racing and gaming
  2  2 commission veterinarian, one chemist employed by the
  2  3 commission or a chemist-representative of the chemical testing
  2  4 laboratory under contract with the commission, a member of the
  2  5 commission staff, and one or more other persons appointed by
  2  6 the administrator having expertise regarding equine
  2  7 medications.  The members of the review committee shall be
  2  8 selected by the administrator of the racing and gaming
  2  9 commission and serve at the administrator's pleasure.  The
  2 10 members will not receive compensation, but they are entitled
  2 11 to reimbursement for actual travel and other expenses incurred
  2 12 while performing the duties of office.
  2 13    The duties of the committee are to analyze and determine
  2 14 the effects of a medication detected in a sample taken from a
  2 15 race horse.  The committee shall gather pertinent information
