  1  4 RELATING TO CERTIFICATION OF PROPERTY TAXES BY TOWNSHIPS AND 
  1  5    PROVIDING AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 359.17, Code 1999, is amended by adding
  1 10 the following new unnumbered paragraph:
  1 11    NEW UNNUMBERED PARAGRAPH.  If a township fails to certify
  1 12 property taxes by March 15, the amount of taxes collected by
  1 13 the county for the township shall be the amount collected for
  1 14 the township in the previous fiscal year to the extent that it
  1 15 does not exceed the applicable levy rate limits in this
  1 16 chapter.  However, that amount may not exceed the amount the
  1 17 township could collect based on property assessments for the
  1 18 fiscal year for which the township failed to certify property
  1 19 taxes.
  1 20    Sec. 2.  TRANSITION.
  1 21    Notwithstanding section 359.17, as amended by this Act, or
  1 22 any other provision of the Code to the contrary, the
  1 23 chairperson of the board of township trustees shall have until
  1 24 May 1, 2000, to certify township property taxes pursuant to
  1 25 that section for property taxes due and payable in the fiscal
  1 26 year beginning July 1, 2000.
  1 27    Sec. 3.  CONTINGENT REPEAL.  If section 359.49, relating to
  1 28 the consequences of a township's failure to certify property
  1 29 taxes, is enacted by 2000 Iowa Acts, House File 2492, section
  1 30 1 of this Act is repealed effective July 1, 2000.
  1 31    Sec. 4.  EFFECTIVE DATE.  This Act, being deemed of
  1 32 immediate importance, takes effect upon enactment.
