  1  4 RELATING TO TRANSPORTATION, BY ENHANCING PENALTIES FOR CERTAIN
  1  5    VEHICLE VIOLATIONS RELATING TO RAILROAD CROSSINGS, MODIFYING
  1  6    VEHICLE REGISTRATION PROVISIONS, REGULATING THE CLOSING OF
  1  7    RAILWAY CROSSINGS, REQUIRING ADOPTION OF RULES FOR HOURS OF
  1  8    SERVICE FOR CERTAIN DRIVERS, AND MODIFYING A DEFINITION 
  1  9    RELATING TO MOTOR VEHICLE DEALERS.

  1 11 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 12 
  1 13    Section 1.  Section 321.20, subsection 1, Code Supplement
  1 14 1999, as amended by 2000 Iowa Acts, Senate File 2147, section
  1 15 39, as enacted, is amended to read as follows:
  1 16    1.  The full legal name; social security number or, if the
  1 17 owner does not have a social security number but has a
  1 18 passport, the passport number; driver's license number,
  1 19 whether the license was issued by this state, another state,
  1 20 another country, or is an international driver's license; date
  1 21 of birth; bona fide residence; and mailing address of the
  1 22 owner and of the lessee if the vehicle is being leased.  If
  1 23 the owner or lessee is a firm, association, or corporation,
  1 24 the application shall contain the business address and federal
  1 25 employer identification number of the owner or lessee.  Up to
  1 26 three owners' names may be listed on the application.
  1 27 Information relating to the lessee of a vehicle shall not be
  1 28 required on an application for registration and a certificate
  1 29 of title for a vehicle with a gross vehicle weight rating of
  1 30 twenty-six ten thousand pounds or more.
  1 31    Sec. 2.  NEW SECTION.  321.344B  IMMEDIATE SAFETY THREAT –
  1 32 PENALTY.
  1 33    A violation of section 321.341, 321.342, 321.343, or
  1 34 321.344 which creates an immediate threat to the safety of a
  1 35 person or property is a simple misdemeanor punishable as a
  2  1 scheduled violation under section 805.8, subsection 2,
  2  2 paragraph "ac".
  2  3    Sec. 3.  Section 321.449, subsection 1, Code Supplement
  2  4 1999, is amended by adding the following new unnumbered
  2  5 paragraph:
  2  6    NEW UNNUMBERED PARAGRAPH.  The department shall also adopt
  2  7 rules concerning hours of service for drivers of vehicles
  2  8 operated for hire and designed to transport more than eight
  2  9 persons, including the driver.  The rules shall not apply to
  2 10 vehicles offered to the public for hire that are used
  2 11 principally in intracity operation and that are regulated by
  2 12 local authorities pursuant to section 321.236.
  2 13    Sec. 4.  Section 322.2, subsection 20, Code 1999, is
  2 14 amended to read as follows:
  2 15    20.  "Selling" includes bartering, exchanging, delivering,
  2 16 or otherwise dealing in.
  2 17    Sec. 5.  NEW SECTION.  327G.25  CLOSING OF CROSSING FOR
  2 18 REPAIR OR UPGRADE.
  2 19    A railway corporation shall not close a railway crossing to
  2 20 the traveling public for more than thirty days for the purpose
  2 21 of repairing or upgrading the crossing.  A railway corporation
  2 22 violating this section shall, upon conviction, be subject to a
  2 23 schedule "one" penalty.
  2 24    Sec. 6.  Section 805.8, subsection 2, paragraph ac, Code
  2 25 Supplement 1999, is amended to read as follows:
  2 26    ac.  For violations of sections 321.341, 321.342, 321.343,
  2 27 and 321.344, the scheduled fine is fifty one hundred dollars.
  2 28 For violations of section 321.344B, the scheduled fine is two
  2 29 hundred dollars.
