  1  4 ESTABLISHING A PILOT PROJECT REQUIRING THAT THE STATE
  1  5    DEPARTMENT OF TRANSPORTATION PURCHASE SOYDIESEL FUEL 
  1  6    FOR USE IN SOME OF ITS VEHICLES, AND PROVIDING FOR 
  1  7    CONTINGENT EFFECTIVENESS.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 159A.2, subsection 8, Code 1999, is
  1 12 amended to read as follows:
  1 13    8.  "Soydiesel fuel" means a fuel which is a mixture of
  1 14 diesel fuel and processed soybean oil, if at least twenty
  1 15 percent of the mixed fuel by volume is processed soybean oil
  1 16 which meets American society for testing and materials
  1 17 standards.
  1 18    Sec. 2.  BIODIESEL FUEL PILOT PROJECT – REPORT.  Beginning
  1 19 September 1, 2000, the state department of transportation
  1 20 shall conduct a biodiesel fuel pilot project at two of the
  1 21 department's field garages in the state which have underground
  1 22 diesel fuel storage tanks.  The pilot project shall be
  1 23 conducted for as long as the department has sufficient funding
  1 24 for the project.  During the course of the pilot project, all
  1 25 of the department's vehicles that use diesel fuel and are
  1 26 based at the designated field garages shall use biodiesel
  1 27 fuel.  A department motor vehicle operating on biodiesel fuel
  1 28 shall be affixed with a brightly visible sticker which
  1 29 notifies the traveling public that the motor vehicle uses
  1 30 biodiesel fuel.  For purposes of this section, "biodiesel
  1 31 fuel" means soydiesel fuel as defined in section 159A.2.
  1 32    The department shall file with the general assembly a
  1 33 preliminary report by February 1, 2001, and a final report by
  1 34 January 1, 2002, on the department's findings and
  1 35 recommendations relating to the pilot project.
  2  1    Sec. 3.  CONTINGENT EFFECTIVENESS.  The section of this Act
  2  2 directing the state department of transportation to conduct a
  2  3 pilot project is effective contingent upon an appropriation by
  2  4 the Seventy-eighth General Assembly, Second Session, to the
  2  5 department for the fiscal year beginning July 1, 2000, which
  2  6 can only be used for the purchase of biodiesel fuel for
  2  7 purposes of the pilot project.
