PAG LIN 1 1 Section 1. Section 232.2, subsection 12, Code Supplement 1 2 1999, is amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. d. The violation of section 724.22, 1 4 subsection 2, that is committed by a child. 1 5 Sec. 2. Section 724.22, subsection 2, Code 1999, is 1 6 amended to read as follows: 1 7 2. Except as provided in subsections 4 and 5, a: 1 8 a. A person who sells, loans, gives, or makes available a 1 9 pistol or revolver or ammunition for a pistol or revolver to a 1 10 person below the age of twenty-one commits a serious 1 11 misdemeanor for a first offense and a class "D" felony for 1 12 second and subsequent offenses. 1 13 b. (1) A person under eighteen years of age who possesses 1 14 a pistol or revolver or ammunition for a pistol or revolver 1 15 commits a delinquent act. 1 16 (2) A person eighteen years of age or older, but under the 1 17 age of twenty-one, who possesses a pistol or revolver or 1 18 ammunition for a pistol or revolver commits a serious 1 19 misdemeanor. 1 20 Sec. 3. NEW SECTION. 724.22A TRIGGER OR GUN LOCKS 1 21 REQUIRED AT POINT-OF-SALE INSTRUCTIONS, INFORMATION, AND 1 22 POSTING. 1 23 1. A person that engages in the retail sale of handguns, 1 24 other than an antique handgun, shall provide to a purchaser at 1 25 the time of the sale of the handgun a trigger lock, gun lock, 1 26 or gun-locking device appropriate for such handgun and shall 1 27 demonstrate its use. 1 28 2. A person that engages in the retail sale of handguns, 1 29 other than an antique handgun, shall post information that 1 30 shall be provided by the department of public safety promoting 1 31 the safe storage of weapons and providing information on the 1 32 availability of weapons training programs. 1 33 3. This section does not apply to the sale of a handgun by 1 34 an individual who is not regularly engaged, either full-time 1 35 or part-time, in a business of selling, buying for resale, or 2 1 exchanging firearms as a principal or agent. 2 2 EXPLANATION 2 3 This bill requires a firearm dealer to provide a gun- 2 4 locking device and certain related information at the time of 2 5 sale of a firearm. 2 6 New Code section 724.22A requires a retail seller to 2 7 provide a trigger lock, gun lock, or other gun-locking device 2 8 to any purchaser of a firearm other than an antique firearm. 2 9 The seller must post on the business premises information 2 10 regarding gun safety courses and the safe storage of firearms 2 11 as provided by the department of public safety. New Code 2 12 section 724.22A does not apply to sales of firearms by 2 13 individuals who are not regularly engaged in the business of 2 14 selling, buying for resale, or exchanging firearms. 2 15 The bill also adds a new provision to Code section 724.22, 2 16 making possession by a minor of a pistol or revolver or 2 17 ammunition for a pistol or revolver a delinquent act, and 2 18 possession of a pistol, revolver, or ammunition for a pistol 2 19 or revolver by a person 18 years or older, but under 21, a 2 20 serious misdemeanor.
