1 1 Section 1. Section 199.1, Code 1999, is amended by adding
1 2 the following new subsections:
1 3 NEW SUBSECTION. 6A. "Genetically engineered" means to
1 4 alter the genetic characteristics of agricultural seed by
1 5 modifying the deoxyribonucleic acid of the agricultural seed
1 6 in a manner other than by pollination.
1 7 NEW SUBSECTION. 6B. "Genetically modified crop seed"
1 8 means agricultural seed used to produce a crop as defined in
1 9 section 202.1, if the agricultural seed has been genetically
1 10 engineered.
1 11 Sec. 2. Section 199.8, Code 1999, is amended by adding the
1 12 following new subsection:
1 13 NEW SUBSECTION. 4. A person shall not sell or offer to
1 14 sell genetically modified crop seed in this state if the
1 15 person includes in the sales price any charges associated with
1 16 genetically engineering the seed.
1 17 EXPLANATION
1 18 This bill amends Code chapter 199, which regulates the sale
1 19 of seed including agricultural seed. The bill amends Code
1 20 section 199.8, which lists a number of illegal activities, by
1 21 prohibiting a person from selling or offering to sell
1 22 genetically modified crop seed in this state if the person
1 23 includes in the sales price any charges associated with
1 24 genetically engineering the seed. Code section 199.9 provides
1 25 a number of exceptions, including seeds which are not sown. A
1 26 person who violates Code section 199.8 is guilty of a simple
1 27 misdemeanor. A simple misdemeanor is punishable by
1 28 confinement for no more than 30 days or a fine of at least $50
1 29 but not more than $500 or by both.
