  1  4 RELATING TO THE USE OF BLUE LIGHTS ON AUTHORIZED EMERGENCY
  1  5    VEHICLES.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 321.324, unnumbered paragraph 1, Code
  1 10 1999, is amended to read as follows:
  1 11    Upon the immediate approach of an authorized emergency
  1 12 vehicle with any lamp or device displaying a red light or red
  1 13 and blue lights, or an authorized emergency vehicle of a fire
  1 14 department displaying a blue light, or when the driver is
  1 15 giving audible signal by siren, exhaust whistle, or bell, the
  1 16 driver of every other vehicle shall yield the right of way and
  1 17 shall immediately drive to a position parallel to, and as
  1 18 close as possible to, the right hand edge or curb of the
  1 19 highway clear of any intersection and shall stop and remain in
  1 20 such position until the authorized emergency vehicle has
  1 21 passed, except when otherwise directed by a police officer.
  1 22 For the purposes of this section, "red light" or "blue light"
  1 23 means a light or lighting device that, when illuminated, will
  1 24 exhibit a solid flashing or strobing red or blue light.
  1 25    Sec. 2.  Section 321.423, subsection 3, Code 1999, is
  1 26 amended by adding the following new paragraph:
  1 27    NEW PARAGRAPH.  c.  An authorized emergency vehicle, other
  1 28 than a vehicle described in paragraph "a" or "b", if the blue
  1 29 light is positioned on the passenger side of the vehicle and
  1 30 is used in conjunction with a red light positioned on the
  1 31 driver side of the vehicle.
  1 32    Sec. 3.  Section 321.423, subsection 3, Code 1999, is
  1 33 amended by adding the following new unnumbered paragraph:
  1 34    NEW UNNUMBERED PARAGRAPH.  A person shall not use only a
  1 35 blue light on a vehicle unless the vehicle meets the
  2  1 requirements of paragraph "a" or "b".
