  1  4 RELATING TO THE ELIGIBILITY OF CERTAIN SCHOOL ORGANIZATIONS
  1  5    TO CONDUCT GAMES AND RAFFLES AND THE DISPOSITION OF RECEIPTS
  1  6    FROM GAMES AND RAFFLES.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 99B.1, Code 1999, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  24.  "Unrelated entity" means a person
  1 13 that has a separate and distinct state charter and tax
  1 14 identification number from any other person, and, if the
  1 15 person is an individual, an individual that is not related by
  1 16 law or by consanguinity.
  1 17    Sec. 2.  Section 99B.7, subsection 1, paragraph m,
  1 18 subparagraph (1), Code l999, is amended to read as follows:
  1 19    (1)  The organization is eligible for exemption from
  1 20 federal income taxes under section 501(c)(3), 501(c)(4),
  1 21 501(c)(5), 501(c)(6), 501(c)(7), 501(c)(8), 501(c)(10), or
  1 22 501(c)(19) of the Internal Revenue Code as defined in section
  1 23 422.3, or in lieu of eligibility for exemption from federal
  1 24 income taxes, the organization is a parent-teacher
  1 25 organization or booster club that is recognized as a fund-
  1 26 raiser and supporter for a school district organized pursuant
  1 27 to chapter 274 or for a school within the school district, in
  1 28 a notarized letter signed by the president of the board of
  1 29 directors, the superintendent of the school district, or a
  1 30 principal of a school within that school district.
  1 31    Sec. 3.  Section 99B.7, Code 1999, is amended by adding the
  1 32 following new subsection:
  1 33    NEW SUBSECTION.  3A.  If a licensee derives ninety percent
  1 34 or more of its total income from conducting bingo, raffles, or
  1 35 small games of chance, at least seventy-five percent of the
  2  1 licensee's net receipts shall be distributed to an unrelated
  2  2 entity for an educational, civic, public, charitable,
  2  3 patriotic, or religious use.
