PAG LIN 1 1 Section 1. Section 216A.114, Code 1999, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 8. Provide for the qualifications of an 1 4 interpreter for deaf and hard-of-hearing persons for the 1 5 purposes of chapter 622B. An interpreter shall be considered 1 6 qualified if the interpreter can show proof that the 1 7 interpreter has been issued a certificate by the registry of 1 8 interpreters for the deaf, has a satisfactory evaluation by 1 9 the national association of the deaf, has a satisfactory 1 10 interpreter skills assessment screening evaluation, or has a 1 11 license, certification, or a satisfactory evaluation or 1 12 screening as an interpreter from another state. 1 13 Sec. 2. Section 622B.1, subsection 2, Code 1999, is 1 14 amended to read as follows: 1 15 2. The supreme court, after consultation with the 1 16 department of human rights, shall adopt rules governing the 1 17qualifications andcompensation of interpreters appearing in a 1 18 proceeding before a court, grand jury, or administrative 1 19 agency under this chapter. However, an administrative agency 1 20 which is subject to chapter 17A may adopt rules differing from 1 21 those of the supreme court governing thequalifications and1 22 compensation of interpreters appearing in proceedings before 1 23 that agency. The qualifications of an interpreter appearing 1 24 in a proceeding before a court, grand jury, or administrative 1 25 agency under this chapter shall be determined by the 1 26 commission on the deaf as provided in section 216A.114. 1 27 EXPLANATION 1 28 This bill provides for the qualifications of interpreters 1 29 for deaf and hard-of-hearing persons. The bill provides that 1 30 the commission on the deaf within the division of deaf 1 31 services of the department of human rights shall provide for 1 32 the qualifications of an interpreter to be used in a court or 1 33 administrative proceeding consistent with the requirements of 1 34 the bill. The bill provides that an interpreter is qualified 1 35 if the interpreter has been issued a certificate by the 2 1 registry of interpreters for the deaf, has a satisfactory 2 2 evaluation by the national association of the deaf, has a 2 3 satisfactory interpreter skills assessment screening 2 4 evaluation, or has a license, certification, or a satisfactory 2 5 evaluation or screening as an interpreter from another state. 2 6 Code section 622B.1 is also amended to provide that the 2 7 commission on the deaf, and not the supreme court or 2 8 applicable administrative agency, determines whether an 2 9 interpreter is qualified for purposes of chapter 622B. 2 10 LSB 5589XS 78 2 11 ec/as/5
