  1  1    Section 1.  Section 715A.6, subsection 2, Code 1999, is
  1  2 amended to read as follows:
  1  3    2.  a.  An offense under this section is a:
  1  4    (1)  A class "D" felony if the value of the property or
  1  5 services secured or sought to be secured by means of the
  1  6 credit card is greater than one thousand dollars, otherwise
  1  7 the offense is an aggravated misdemeanor.
  1  8    (2)  An aggravated misdemeanor if the value of the property
  1  9 or services secured or sought to be secured by means of the
  1 10 credit card is equal to or less than one thousand dollars.
  1 11    b.  If two or more acts under this section are committed
  1 12 against the same person or involve the same location, or are
  1 13 committed against different persons but occur in such a manner
  1 14 that the acts are attributable to a single scheme, plan, or
  1 15 conspiracy, the acts may be considered a single offense under
  1 16 this section and the value of the property or services secured
  1 17 or sought to be secured by means of the credit card for
  1 18 purposes of determining the punishment under this section
  1 19 shall be the total value of all the property or services
  1 20 secured or sought to be secured.  
  1 21                           EXPLANATION
  1 22    This bill amends Code section 715A.6 relating to the
  1 23 fraudulent use of a credit card.  The bill provides for
  1 24 aggregation of the value of property or services secured with
  1 25 the credit card for the purposes of determining the punishment
  1 26 associated with the offense, similar to the statute relating
  1 27 to the determination of total value of property under Code
  1 28 section 714.3 relating to theft.  The bill also makes
  1 29 technical changes by reorganizing the subsection.
