PAG LIN 1 1 SENATE FILE 2111 1 2 1 3 AN ACT 1 4 RELATING TO CERTAIN SCHOOL FINANCE FORMULA PROVISIONS AND 1 5 PROVIDING AN EFFECTIVE DATE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 257.13, Code Supplement 1999, is 1 10 amended by striking the section and inserting in lieu thereof 1 11 the following: 1 12 257.13 ON-TIME FUNDING BUDGET ADJUSTMENT. 1 13 1. For the school budget year beginning July 1, 2000, if a 1 14 district's actual enrollment for the budget year, determined 1 15 under section 257.6, is greater than its budget enrollment for 1 16 the budget year, the district shall be eligible to receive an 1 17 on-time funding budget adjustment. The adjustment shall be in 1 18 an amount equal to fifty percent of the difference between the 1 19 actual enrollment for the budget year and the budget 1 20 enrollment for the budget year, multiplied by district cost 1 21 per pupil. 1 22 2. The board of directors of a school district that wishes 1 23 to receive an on-time funding budget adjustment shall adopt a 1 24 resolution to receive the adjustment and notify the school 1 25 budget review committee by November 1, 2000. The school 1 26 budget review committee shall establish a modified allowable 1 27 growth in an amount determined pursuant to subsection 1. 1 28 3. If the board of directors of a school district 1 29 determines that a need exists for additional funds exceeding 1 30 the authorized budget adjustment for on-time funding pursuant 1 31 to this section, a request for modified allowable growth based 1 32 upon increased enrollment may be submitted to the school 1 33 budget review committee as provided in section 257.31. 1 34 Sec. 2. Section 257.14, subsection 1, Code Supplement 1 35 1999, is amended to read as follows: 2 1 1. For the budgetyearsyear commencingJuly 1, 1997, July2 21, 1998, andJuly 1,19992000, if the department of 2 3 management determines that the regular program district cost 2 4 of a school district for a budget year is less than the total 2 5 of the regular program district cost plus any adjustment added 2 6 under this section for the base year for that school district, 2 7 thedepartment of management shall provideschool district 2 8 shall be eligible to receive a budget adjustment for that 2 9 district for that budget yearthat isup to an amount equal to 2 10 the difference. The board of directors of a school district 2 11 that wishes to receive a budget adjustment pursuant to this 2 12 subsection shall, notwithstanding the public notice and 2 13 hearing provisions of chapter 24 or any other provision to the 2 14 contrary, within thirty days following the enactment of this 2 15 Act adopt a resolution to receive the budget adjustment and 2 16 immediately notify the department of management of the 2 17 adoption of the resolution and the amount of the budget 2 18 adjustment to be received. 2 19 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 20 immediate importance, takes effect upon enactment. 2 21 2 22 2 23 2 24 MARY E.
