PAG LIN 1 1 SENATE FILE 2007 1 2 1 3 AN ACT 1 4 RELATING TO RESPONSIBILITIES OF A GUARDIAN IN PROCURING 1 5 PROFESSIONAL SERVICES FOR A WARD WITH A PHYSICAL OR MENTAL 1 6 DISABILITY WHICH DO NOT REQUIRE PRIOR COURT APPROVAL. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 633.635, subsection 1, paragraph e, 1 11 Code 1999, is amended to read as follows: 1 12 e. Ensuring the ward receives professional care, 1 13 counseling, treatment or services as needed. If necessitated 1 14 by the physical or mental disability of the ward, the 1 15 provision of professional care, counseling, treatment, or 1 16 services limited to the provision of routine physical and 1 17 dental examinations and procedures under anesthesia is 1 18 included, if the anesthesia is provided within the scope of 1 19 the health care practitioner's scope of practice. 1 20 Sec. 2. Section 633.635, subsection 2, paragraph b, Code 1 21 1999, is amended to read as follows: 1 22 b. Arranging the provision of major elective surgery or 1 23 any other nonemergency major medical procedure. For the 1 24 purposes of this paragraph, "major elective surgery" and 1 25 "nonemergency major medical procedure" do not include the 1 26 provision to the ward of professional care, counseling, 1 27 treatment, or services limited to the provision of routine 1 28 physical and dental examinations and procedures under 1 29 anesthesia, if the use of anesthesia is necessitated by the 1 30 physical or mental disability of the ward, and if the 1 31 anesthesia is provided within the scope of the health care 1 32 practitioner's scope of practice. 1 33 Sec. 3. Section 633.635, Code 1999, is amended by adding 1 34 the following new subsection: 1 35 NEW SUBSECTION. 2A. For the purposes of this section: 2 1 a. "Routine dental examinations and procedures" includes 2 2 preventive services, diagnostic services, restorative 2 3 services, periodontal services, endodontic services, oral 2 4 surgery, prosthetic services, and orthodontic procedures. 2 5 b. "Routine physical examinations and procedures" includes 2 6 examinations and procedures performed for the purpose of 2 7 general treatment or diagnosis or for the purpose of treatment 2 8 or diagnosis related to a specific illness, symptom, 2 9 complaint, or injury. 2 10 2 11 2 12 2 13 MARY E.
