PAG LIN 1 1 SENATE FILE 441 1 2 1 3 AN ACT 1 4 PROVIDING AN EXEMPTION FROM CERTAIN REQUIREMENTS OF SELF-INSURED 1 5 DENTAL INSURANCE PLANS PROVIDED BY SCHOOL CORPORATIONS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 509A.15, Code 1999, is amended by 1 10 adding the following new subsection: 1 11 NEW SUBSECTION. 4. One or more school corporations 1 12 maintaining a self-insured dental insurance plan, with yearly 1 13 claims which do not exceed one percent of the school 1 14 corporation's general fund budget, shall be exempt from the 1 15 following requirements with respect to that plan: 1 16 a. Maintaining aggregate excess loss coverage required by 1 17 rules relating to the adequacy of reserves adopted pursuant to 1 18 subsection 1, paragraph "b". 1 19 b. Contracting with a third-party administrator pursuant 1 20 to subsection 1, paragraph "d". 1 21 The yearly claim amount shall be determined annually on the 1 22 policy renewal date, or an alternative date established by 1 23 rule, by a plan administrator or school corporation employee 1 24 to be designated by the plan administrator. The exemption 1 25 shall not apply for the year following a year in which yearly 1 26 claims are determined to exceed one percent of the school 1 27 corporation's general fund budget. 1 28 1 29 1 30 1 31 MARY E.
