  1  4 APPLYING CERTAIN VETERINARY PRACTICE REQUIREMENTS TO PERSONS
  1  5    PROVIDING VETERINARY MEDICAL SERVICES, OWNING A VETERINARY
  1  6    CLINIC, OR PRACTICING VETERINARY MEDICINE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 169.5, Code 1999, is amended by adding
  1 11 the following new subsection:
  1 12    NEW SUBSECTION.  10.  A person who provides veterinary
  1 13 medical services, owns a veterinary clinic, or practices in
  1 14 this state shall obtain a certificate from the board and be
  1 15 subject to the same standards of conduct, as provided in this
  1 16 chapter and rules adopted by the board, as apply to a licensed
  1 17 veterinarian, unless the board determines that the same
  1 18 standards of conduct are inapplicable.  The board shall issue,
  1 19 renew, or deny a certificate; adopt rules relating to the
  1 20 standards of conduct; and take disciplinary action against the
  1 21 person, including suspension or revocation of a certificate,
  1 22 in accordance with the procedures established in section
  1 23 169.14.  Certification fees shall be established by the board
  1 24 pursuant to section 169.5, subsection 9, paragraph "j".  Fees
  1 25 shall be established in an amount sufficient to fully offset
  1 26 the costs of certification pursuant to this subsection.  For
  1 27 the fiscal year beginning July 1, 2001, and ending June 30,
  1 28 2002, the department shall retain fees collected to administer
  1 29 the program of certifying veterinary clinics and the fees
  1 30 retained are appropriated to the department for the purposes
  1 31 of this subsection.  For the fiscal year beginning July 1,
  1 32 2001, and ending June 30, 2002, notwithstanding section 8.33,
  1 33 fees which remain unexpended at the end of the fiscal year
  1 34 shall not revert to the general fund of the state but shall be
  1 35 available for use for the following fiscal year to administer
  2  1 the program.  For the fiscal year beginning July 1, 2002, and
  2  2 succeeding fiscal years, certification fees shall be deposited
  2  3 in the general fund of the state and are appropriated to the
  2  4 department to administer the certification provisions of this
  2  5 subsection.  This subsection shall not apply to an animal
  2  6 shelter, as defined in section 162.2, that provides veterinary
  2  7 medical services to animals in the custody of the shelter.
  2  8    Sec. 2.  CERTIFICATION PROGRAM REPORT.  The board of
  2  9 veterinary medicine shall, prior to the implementation of the
  2 10 veterinary clinic certification program pursuant to section 1
  2 11 of this Act, submit a report to the general assembly prior to
  2 12 January 1, 2001, regarding the status of the board's
  2 13 development of the certification program.  The report shall
  2 14 include the criteria to be used for certification, the methods
  2 15 and procedures to be used in the certification process, the
  2 16 anticipated cost of operating the certification program, the
  2 17 estimated certification fee to be charged each clinic, and the
  2 18 general manner of implementation of the program.
  2 19    Sec. 3.  EFFECTIVE DATE.  Section 1 of this Act, amending
  2 20 section 169.5, takes effect July 1, 2001.
