1 1 Section 1. Section 142B.6, unnumbered paragraph 3, Code
1 2 1999, is amended to read as follows:
1 3 Enforcement of this chapter shall be implemented in an
1 4 equitable manner throughout the state. For the purpose of
1 5 equitable and uniform implementation, application, and
1 6 enforcement of state and local laws and regulations, the
1 7 provisions of this chapter shall supersede any local law or
1 8 regulation which is inconsistent with or conflicts with the
1 9 provisions of this chapter. However, a local law enforcement
1 10 agency is authorized to enforce the provisions of this
1 11 chapter.
1 12 EXPLANATION
1 13 This bill amends Code chapter 142B which restricts smoking
1 14 in certain public areas. The bill provides that a local law
1 15 enforcement agency may enforce Code chapter 142B as long as
1 16 the enforcement is implemented in an equitable manner
1 17 throughout the state as required by Code section 142B.6.
