PAG LIN 1 1 SENATE FILE 361 1 2 1 3 AN ACT 1 4 RELATING TO ENFORCEMENT, PREVENTION, EDUCATION, AND TREATMENT 1 5 FOR SUBSTANCE ABUSE AND SEXUAL ABUSE, AND PROVIDING APPRO- 1 6 PRIATIONS. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 DIVISION I 1 11 Section 1. ENFORCEMENT. There is appropriated from the 1 12 general fund of the state to the department of public safety, 1 13 for the fiscal year beginning July 1, 1999, and ending June 1 14 30, 2000, the following amounts, or so much thereof as is 1 15 necessary, to be used for the purposes designated: 1 16 1. For the division of narcotics enforcement: 1 17 For the employment of six narcotics enforcement agents, and 1 18 for not more than the following full-time equivalent 1 19 positions: 1 20 .................................................. $ 505,000 1 21 ............................................... For the division of criminal investigation: 1 23 For two criminalists for the division's laboratory who will 1 24 primarily focus on methamphetamine testing, and for not more 1 25 than the following full-time equivalent positions: 1 26 .................................................. $ 80,956 1 27 ............................................... FTEs 2.00 1 28 3. For the establishment of a clandestine methamphetamine 1 29 laboratory emergency response team within the department, and 1 30 for not more than the following full-time equivalent 1 31 positions: 1 32 .................................................. $ 980,000 1 33 ............................................... FTEs 13.00 1 34 The clandestine methamphetamine laboratory emergency 1 35 response team established pursuant to this subsection shall 2 1 consist of five narcotics agents, one fire marshal special 2 2 agent, five state patrol officers, one division of criminal 2 3 investigation investigator, and one division of narcotics 2 4 enforcement technical support employee. 2 5 Sec. 2. YOUTH LEADERSHIP MODEL. There is appropriated 2 6 from the general fund of the state to the Iowa department of 2 7 corrections for the fiscal year beginning July 1, 1999, and 2 8 ending June 30, 2000, the following amount, or so much thereof 2 9 as is necessary, to be used for the purpose designated: 2 10 For youth leadership model programs to help at-risk youth 2 11 in the judicial district departments of correctional services 2 12 selected by the department: 2 13 .................................................. $ 100,000 2 14 The department of corrections shall establish criteria for 2 15 judicial district departments of correctional services to 2 16 apply for and receive moneys from the department for 2 17 assistance in implementing a youth leadership model program. 2 18 As a part of the program, the judicial district department 2 19 of correctional services may recruit, to work with at-risk 2 20 children, college or high school students in the judicial 2 21 district, regardless of gender, recommended by their 2 22 respective schools as good role models, including, but not 2 23 limited to, students who possess ability in one or more of the 2 24 following areas: intellectual ability, leadership ability, 2 25 athletic ability, visual arts ability, or performing arts 2 26 ability. 2 27 Sec. 3. DRUG COURT PILOT PROGRAMS. The governor's 2 28 alliance on substance abuse shall subgrant on a reimbursement 2 29 basis from moneys received by the alliance under the federal 2 30 Edward Byrne memorial state and local law enforcement 2 31 assistance program to the department of corrections for the 2 32 fiscal year beginning July 1, 1999, and ending June 30, 2000, 2 33 the following amount, or so much thereof as is necessary, to 2 34 be used for the purpose designated: 2 35 For expenses associated with establishment of two drug 3 1 court pilot programs: 3 2 .................................................. $ 60,000 3 3 The director of the department of corrections shall 3 4 designate from any appropriation from the general fund of the 3 5 state to the department for the fiscal year beginning July 1, 3 6 1999, and ending June 30, 2000, the amount necessary to 3 7 provide a match for the expenses associated with the 3 8 establishment of the two drug court pilot programs and, if a 3 9 transfer of funds is required, the notice provisions of 3 10 section 8.39 do not apply. 3 11 DIVISION II 3 12 Sec. 4. JUVENILE DELINQUENT TREATMENT. There is 3 13 appropriated from the general fund of the state to the 3 14 department of human services for the state training school at 3 15 Eldora, for the fiscal year beginning July 1, 1999, and ending 3 16 June 30, 2000, the following amount, or so much thereof as is 3 17 necessary, to be used for the purpose designated: 3 18 For providing treatment programs for every substance abuser 3 19 and sexual predator placed at the state training school 3 20 needing treatment: 3 21 .................................................. $ 62,000 3 22 Sec. 5. Section 217.12, subsection 3, paragraph b, Code 3 23 1999, is amended to read as follows: 3 24 b. Designation of the services to be provided for the 3 25 families served, including assistance regarding job-seeking 3 26 skills, family budgeting, nutrition, self-esteem, 3 27 methamphetamine education, health and hygiene, child rearing, 3 28 child education preparation, and goal setting. Grant 3 29 proposals shall indicate the support groups and support 3 30 systems to be developed for the families served during the 3 31 transition between the need for assistance and self- 3 32 sufficiency. 3 33 DIVISION III 3 34 Sec. 6. METHAMPHETAMINE TREATMENT. There is appropriated 3 35 from the general fund of the state to the Iowa department of 4 1 public health for the fiscal year beginning July 1, 1999, and 4 2 ending June 30, 2000, the following amounts, or so much 4 3 thereof as is necessary, to be used for the purposes 4 4 designated: 4 5 1. For additional methamphetamine treatment under the 4 6 substance abuse treatment program: 4 7 .................................................. $ 1,500,000 4 8 2. For development of a model substance abuse prevention 4 9 program based upon the North high school program in Des 4 10 Moines: 4 11 .................................................. $ 30,000 4 12 Information about the model substance abuse prevention 4 13 program developed under this subsection shall be distributed 4 14 to schools in this state that have a high percent of students 4 15 susceptible to substance abuse, particularly methamphetamine 4 16 abuse, to assist those schools that are submitting 4 17 applications for competitive grants from the department. 4 18 Sec. 7. YOUTH LEADERSHIP CONFERENCE ON MENTORING. There 4 19 is appropriated from the general fund of the state to the 4 20 governor's alliance on substance abuse for the fiscal year 4 21 beginning July 1, 1999, and ending June 30, 2000, the 4 22 following amount, or so much thereof as is necessary, to be 4 23 used for the purpose designated: 4 24 For planning and holding a youth leadership conference on 4 25 mentoring for individuals who agree to serve as mentors to 4 26 youth to help reduce substance abuse, especially 4 27 methamphetamine abuse, in schools: 4 28 .................................................. $ 20,000 4 29 Sec. 8. NEW SECTION. 135.16 SPECIAL WOMEN, INFANTS, AND 4 30 CHILDREN SUPPLEMENTAL FOOD PROGRAM FUNDING ALLOCATION. 4 31 As a component of the federal funding received by the 4 32 department as the administering agency for the special women, 4 33 infants, and children supplemental food program, from the 4 34 United States department of agriculture, food and consumer 4 35 service, the department shall incorporate a methamphetamine 5 1 education program into its nutrition and health-related 5 2 education services. The department shall be responsible for 5 3 the development of the education program to be delivered, and 5 4 for the selection of qualified contract agencies to deliver 5 5 the instruction under the program. 5 6 DIVISION IV 5 7 Sec. 9. LABOR MANAGEMENT SUBSTANCE ABUSE EDUCATION 5 8 PROGRAM. The executive council shall transfer from the health 5 9 insurance surplus account to the department of personnel for 5 10 the fiscal year beginning July 1, 1999, and ending June 30, 5 11 2000, the following amount, or so much thereof as is 5 12 necessary, which is appropriated to be used for the purpose 5 13 designated: 5 14 For development of a labor management substance abuse 5 15 education program, with an emphasis on methamphetamine abuse, 5 16 that can serve as a model to be used by labor and management 5 17 throughout the state: 5 18 .................................................. $ 30,000 5 19 DIVISION V 5 20 Sec. 10. STRENGTHENING FAMILIES PROGRAM. 5 21 1. The cooperative extension service at Iowa state 5 22 university, in association with the institute of social and 5 23 behavioral research at Iowa state university, shall develop a 5 24 strengthening families program to provide funding and 5 25 assistance to communities for families who have children 5 26 between the ages of 10 and 14 years of age for prevention of 5 27 substance abuse with an emphasis on prevention of 5 28 methamphetamine abuse. Communities participating in the 5 29 program must contract with the cooperative extension service 5 30 and provide a match for the cooperative extension service to 5 31 bring the program to the community. However, communities 5 32 participating in federally funded research activities through 5 33 the institute for social and behavioral research at Iowa state 5 34 university on the effective date of this Act are not eligible 5 35 to participate in the program. 6 1 2. The governor's alliance on substance abuse shall 6 2 subgrant on a reimbursement basis an amount not exceeding 6 3 $270,000 of moneys received by the alliance under the federal 6 4 Edward Byrne memorial state and local law enforcement 6 5 assistance program to support the strengthening families 6 6 program. A strengthening families program fund is established 6 7 in the office of the treasurer of state under the authority of 6 8 the department of education. The moneys shall be distributed 6 9 on a first-come, first-served matching funds basis by the 6 10 department of education to communities participating in the 6 11 strengthening families program. 6 12 Notwithstanding section 8.33, moneys in the fund that 6 13 remain unencumbered or unobligated at the close of the fiscal 6 14 year shall not revert but shall remain available for 6 15 expenditure for the purposes designated until the close of the 6 16 succeeding fiscal year. 6 17 3. The cooperative extension service shall solicit the 6 18 assistance of the department of education, the Iowa department 6 19 of public health, and other public and private agencies 6 20 providing services to families in promoting the program. 6 21 4. There is appropriated from the general fund of the 6 22 state to the department of education for the fiscal year 6 23 beginning July 1, 1999, and ending June 30, 2000, the 6 24 following amount, or so much thereof as is necessary, to be 6 25 used for the purpose designated: 6 26 For communities to participate in the strengthening 6 27 families program: 6 28 .................................................. $ 50,000 6 29 Sec. 11. Section 279.51, subsection 1, paragraph d, Code 6 30 1999, is amended to read as follows: 6 31 d. For the fiscal year beginning July 1, 1996, and for 6 32 each fiscal year thereafter, three million five hundred 6 33 thousand dollars of the funds appropriated shall be allocated 6 34 as grants to school districts that have elementary schools 6 35 that demonstrate the greatest need for programs for at-risk 7 1 students with preference given to innovative programs for the 7 2 early elementary school years. School districts receiving 7 3 grants under this paragraph shall at a minimum provide 7 4 activities and materials designed to encourage children's 7 5 self-esteem, provide role modeling and mentoring techniques in 7 6 social competence and social skills, and discourage 7 7 inappropriate drug use. The grant allocations made in this 7 8 paragraph may be renewed for additional periods of time. Of 7 9 the amount allocated under this paragraph for each fiscal 7 10 year, seventy-five thousand dollars shall be allocated to 7 11 school districts which have an actual student population of 7 12 ten thousand or less and have an actual non-English speaking 7 13 student population which represents greater than five percent 7 14 of the total actual student population for grants to 7 15 elementary schools in those districts. 7 16 Sec. 12. Section 279.51, subsection 3, unnumbered 7 17 paragraph 3, Code 1999, is amended to read as follows: 7 18 Programs shall provide at a minimum recreation 7 19 opportunities,; personal skills development,; activities and 7 20 materials designed to encourage children's self-esteem, 7 21 provide role modeling and mentoring techniques in social 7 22 competence and social skills, and discourage inappropriate 7 23 drug use; basic academic skills development,; family 7 24 interaction opportunities,; and mentoring. Additional 7 25 objectives of the programs shall be: to increase the ability 7 26 of existing agencies within the community to address the 7 27 multiple problems of children and youth and to coordinate 7 28 their activities and to facilitate joint planning to make the 7 29 most economic and innovative use of community resources. 7 30 Priority shall be given to programs that provide access to a 7 31 center for children and youth after school, in the evening, 7 32 and on weekends, and during the summer and that provide a 7 33 twenty-four-hour telephone hotline or similar service, and 7 34 that provide access to day care or on-site child day care. 7 35 Programs shall at a minimum provide career development 8 1 services, mental health and family counseling services, and 8 2 primary health care services that include but are not limited 8 3 to physical examinations, immunizations, hearing and vision 8 4 screening, and preventive and primary health care services, in 8 5 the context of the educational needs of the students. 8 6 Programs shall not include abortion counseling or the 8 7 dispensing of contraceptives. 8 8 8 9 8 10 8 11 MARY E.
