PAG LIN 1 1 Section 1. Section 461A.3, Code 1999, is amended to read 1 2 as follows: 1 3 461A.3 DUTIES AS TO PARKS. 1 4 1. It shall be the duty of the commission to establish, 1 5 maintain, improve, and beautify public parks and preserves 1 6 upon the shores of lakes, streams, or other waters, or at 1 7 other places within the state which have become historical or 1 8 which are of scientific interest, or which by reason of their 1 9 natural scenic beauty or location are adapted therefor. 1 10 2. The commission shall have the power to maintain, 1 11 improve or beautify state-owned bodies of water, and to 1 12 provide proper public access thereto. When the lakes under 1 13 the jurisdiction of the commission are evaluated to establish 1 14 priority for improvement or rehabilitation, the commission 1 15 shall evaluate glacial lakes separately from artificial and 1 16 other natural lakes. Criteria related to the eligibility for 1 17 funds shall not include the proximity of human habitation or 1 18 another lake to a glacial lake. The commission shall give 1 19 priority to glacial lakes when allocating moneys for dredging. 1 20 3. The commission shall have the power to provide and 1 21 operate facilities for the proper public use of the areas 1 22abovedescribed in subsections 1 and 2. 1 23 4. The commission shall open all roads which pass through 1 24 the Ledges State Park from September 15 to November 1 of each 1 25 year. 1 26 EXPLANATION 1 27 This bill provides that the natural resource commission of 1 28 the department of natural resources evaluate glacial lakes 1 29 separately from artificial and other natural lakes for the 1 30 purposes of establishing priority for improvement or 1 31 maintenance. The commission shall not consider criteria 1 32 relating to the proximity of human habitation or another lake 1 33 when evaluating glacial lakes.
