1 1 Section 1. Section 717A.1, subsection 2, Code 1999, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. d. Enter onto or into an animal facility
1 4 with or without the consent of the owner and use mechanical or
1 5 electronic equipment, including a camera or tape recorder, to
1 6 make a visual image or audio recording of the animal facility
1 7 without the consent of the owner.
1 8 Sec. 2. Section 717A.1, subsection 3, Code 1999, is
1 9 amended by adding the following new paragraph:
1 10 NEW PARAGRAPH. d. A person who violates subsection 2,
1 11 paragraph "d", is guilty of an aggravated misdemeanor.
1 12 EXPLANATION
1 13 This bill amends Code section 717A.1 which in part provides
1 14 criminal penalties for persons who enter onto the premises of
1 15 an establishment used to maintain animals, referred to as an
1 16 animal facility, without the consent of the owner of the
1 17 facility or owner of the animal. This bill prohibits a person
1 18 from entering onto the premises of an animal facility and
1 19 using mechanical or electronic equipment, including a camera
1 20 or tape recorder, to make a visual image or audio recording of
1 21 the animal facility without the consent of the owner. The
1 22 bill provides that a person who violates the provision is
1 23 guilty of an aggravated misdemeanor.
