1 4 ALLOWING CERTAIN UTILITY EMPLOYEES TO OPERATE ALL-TERRAIN
1 5 VEHICLES AND SNOWMOBILES ON RAILROAD RIGHTS OF WAY.

1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 9 Section 1. Section 321G.13, subsection 8, Code 1999, is
1 10 amended to read as follows:
1 11 8. Upon an operating railroad right of way. An all-
1 12 terrain vehicle or snowmobile may be driven directly across a
1 13 railroad right of way only at an established crossing and,
1 14 notwithstanding any other provisions of law, may, if
1 15 necessary, use the improved portion of the established
1 16 crossing after yielding to all oncoming traffic. This
1 17 subsection does not apply to a law enforcement officer or
1 18 railroad employee in the lawful discharge of the officer's or
1 19 employee's duties or to an employee of a utility with
1 20 authority to enter upon the railroad right of way in the
1 21 lawful performance of the employee's duties.
