PAG LIN 1 1 Section 1. Section 256.11, Code 1999, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 9. Unless a waiver has been obtained 1 4 under section 256.11A, each school or school district shall 1 5 provide an articulated sequential elementary-secondary 1 6 guidance program for grades kindergarten through twelve and a 1 7 guidance counselor who meets the licensing standards 1 8 prescribed by the board of educational examiners. In 1 9 determining the requirements of this subsection for nonpublic 1 10 schools, the department shall evaluate the schools on a school 1 11 system basis rather than on an individual school basis. 1 12 Sec. 2. Section 256.11A, subsection 1, Code 1999, is 1 13 amended to read as follows: 1 14 1.Schools and school districts unable to meet the1 15standard adopted by the state board requiring each school or1 16school district operating a kindergarten through grade twelve1 17program to provide an articulated sequential elementary-1 18secondary guidance programThe board of directors of a school 1 19 district or the authorities in charge of a nonpublic school 1 20 may, not later than August 1,19951999, for the school year 1 21 beginning July 1,19951999, file a written request to the 1 22 department of education that the department waive the 1 23 requirementfor, established in section 256.11, subsection 9, 1 24 that a school or school district operating a kindergarten 1 25 through grade twelve program, provide an articulated 1 26 sequential elementary-secondary guidance program and a 1 27 guidance counselor who meets the licensing standards 1 28 prescribed by the board of educational examiners. The 1 29 procedures specified in subsection 3 apply to the request. 1 30 Not later than August 1,19962000, for the school year 1 31 beginning July 1,19962000, the board of directors of a 1 32 school district or the authorities in charge of a nonpublic 1 33 school may request a one-year extension of the waiver. 1 34 Sec. 3. STATE MANDATE FUNDING SPECIFIED. In accordance 1 35 with section 25B.2, subsection 3, the state cost of requiring 2 1 compliance with any state mandate included in this Act shall 2 2 be paid by a school district from state school foundation aid 2 3 received by the school district under section 257.16. This 2 4 specification of the payment of the state cost shall be deemed 2 5 to meet all the state funding-related requirements of section 2 6 25B.2, subsection 3, and no additional state funding shall be 2 7 necessary for the full implementation of this Act by and 2 8 enforcement of this Act against all affected school districts. 2 9 EXPLANATION 2 10 This bill reestablishes a statutory requirement that each 2 11 accredited nonpublic school or school district have for grades 2 12 kindergarten through 12, unless a waiver has been obtained, an 2 13 articulated sequential elementary-secondary guidance program 2 14 and a guidance counselor who meets the licensing standards 2 15 prescribed by the board of educational examiners. The bill 2 16 also provides that a school may apply for a waiver to the 2 17 requirement by August 1, 1999, and by August 1, 2000, for 2 18 school years 1999-2000 and 2000-2001. 2 19 This bill may include a state mandate as defined in Code 2 20 section 25B.3. The bill requires that the state cost of any 2 21 state mandate included in the bill be paid by a school 2 22 district from state school foundation aid received by the 2 23 school district under Code section 257.16. The specification 2 24 is deemed to constitute state compliance with any state 2 25 mandate funding-related requirements of Code section 25B.2. 2 26 The inclusion of this specification is intended to reinstate 2 27 the requirement of political subdivisions to comply with any 2 28 state mandates included in the bill. 2 29 LSB 1772SS 78 2 30 kh/cf/24.1
