  1  1    Section 1.  Section 34A.2, subsection 5, paragraph e,
  1  2 subparagraph (2), Code 1999, is amended to read as follows:
  1  3    (2)  Recurring costs, including, but not limited to,
  1  4 network access fees and other telephone charges, software,
  1  5 equipment, and database management, and maintenance, including
  1  6 the purchase or lease of subscriber names, addresses, and
  1  7 telephone information from the local exchange service
  1  8 provider.  Recurring costs shall not include personnel costs
  1  9 for a public safety answering point except as provided in
  1 10 section 34A.10.
  1 11    Sec. 2.  NEW SECTION.  34A.10  SURCHARGE MONEYS –
  1 12 PERMISSIBLE EXPENDITURE ON PERSONNEL.
  1 13    If, after fully paying obligations under section 34A.7,
  1 14 subsection 5, paragraph "b", subparagraphs (1) and (2), for a
  1 15 budget year, moneys remain in an E911 service fund at the end
  1 16 of that budget year in excess of a surplus of twenty-five
  1 17 percent of the approved annual operating budget for the next
  1 18 budget year, the joint E911 service board may expend such
  1 19 excess moneys during the next budget year for the cost of
  1 20 support personnel at a public safety answering point.  The
  1 21 joint E911 board shall inform the administrator that such
  1 22 expenditure will be made in lieu of the administrator reducing
  1 23 the surcharge.  Personnel for which such expenditures are made
  1 24 must be associated with providing E911 service.  
  1 25                           EXPLANATION
  1 26    This bill provides that if moneys remain in an E911 service
  1 27 fund at the end of a budget year in excess of the 25 percent
  1 28 surplus requirement after fully paying all obligations for
  1 29 that budget year, the joint E911 service board may expend such
  1 30 excess moneys during the next budget year for the cost of
  1 31 support personnel at a public safety answering point.  The
  1 32 joint E911 board must inform the administrator that such
  1 33 expenditure will be made in lieu of the administrator reducing
  1 34 the surcharge.  Personnel for which such expenditures are made
  1 35 must be associated with providing E911 service.
