1 1 Section 1. Section 39.9, Code 1999, is amended by adding
1 2 the following new unnumbered paragraph:
1 3 NEW UNNUMBERED PARAGRAPH. A person shall not be elected
1 4 for a term as secretary of agriculture if the term would
1 5 result in more than a total of twelve years of service as
1 6 secretary of agriculture. If a person is elected or appointed
1 7 to serve a portion of a term to which some other person was
1 8 elected or appointed but that person died in office or
1 9 resigned from office or was otherwise removed from office,
1 10 those years served shall not be included in the years of
1 11 service for purposes of this limitation.
1 12 Sec. 2. This Act takes effect upon ratification of an
1 13 amendment to the Constitution of the State of Iowa limiting to
1 14 twelve years of service, persons elected to the offices of
1 15 governor, lieutenant governor, attorney general, secretary of
1 16 state, auditor of state, and treasurer of state, and as
1 17 members of the Iowa senate and limiting to twelve years of
1 18 service, persons elected as members of the Iowa house of
1 19 representatives.
1 20 Sec. 3. This Act applies to terms of office beginning on
1 21 or after January 1 following the effective date of this Act.
1 22 EXPLANATION
1 23 This bill provides that a person elected to the office of
1 24 Iowa secretary of agriculture is limited to no more than 12
1 25 years of service. Partial terms to which another person was
1 26 initially elected or appointed are not included in the years
1 27 of service.
1 28 The bill takes effect upon ratification of an amendment to
1 29 the Iowa Constitution limiting the governor, lieutenant
1 30 governor, attorney general, secretary of state, auditor of
1 31 state, treasurer of state, members of the Iowa senate and
1 32 members of the Iowa house of representatives to 12 years of
1 33 service. The bill applies to terms of office beginning on or
1 34 after January 1 following the effective date of the bill.
