PAG LIN 1 1 Section 1. Section 426B.1, subsections 2 and 3, Code 1999, 1 2 are amended to read as follows: 1 3 2. There is appropriated to the property tax relief fund 1 4 for the indicated fiscal years from the general fund of the 1 5 state the following amounts: 1 6a. For the fiscal year beginning July 1, 1995, sixty-one1 7million dollars.1 8b. For the fiscal year beginning July 1, 1996, seventy-1 9eight million dollars.1 10c.a. For the fiscal year beginning July 1,19971998,and1 11succeeding fiscal years,ninety-five million dollars. 1 12 b. For the fiscal year beginning July 1, 1999, one hundred 1 13 thirty-six million nine hundred twenty-eight thousand dollars. 1 14 c. For the fiscal year beginning July 1, 2000, one hundred 1 15 seventy-eight million eight hundred fifty-four thousand 1 16 dollars. 1 17 d. For the fiscal year beginning July 1, 2001, and 1 18 succeeding fiscal years, two hundred twenty million seven 1 19 hundred eighty-two thousand dollars. 1 20 3. There is annually appropriated from the property tax 1 21 relief fund to the department of human services to supplement 1 22 the medical assistance appropriation for the fiscal year 1 23 beginning July 1,19971998, and for succeeding fiscal years, 1 24 six million six hundred thousand dollars to be used for the 1 25 nonfederal share of the costs of services provided to minors 1 26 with mental retardation under the medical assistance program 1 27 to meet the requirements of section 249A.12, subsection 4. 1 28The appropriation in this subsection shall be charged to the1 29property tax relief fund prior to the distribution of moneys1 30from the fund under section 426B.2 and the amount of moneys1 31available for distribution shall be reduced accordingly.1 32However, the appropriation in this subsection shall be1 33considered to be a property tax relief payment for purposes of1 34the combined amount of payments required to achieve fifty1 35percent of the counties' base year expenditures as provided in2 1section 426B.2, subsection 2.2 2 Sec. 2. Section 426B.2, subsection 2, Code 1999, is 2 3 amended by striking the subsection. 2 4 Sec. 3. EFFECTIVE DATE AND APPLICABILITY. This Act, being 2 5 deemed of immediate importance, takes effect upon enactment 2 6 and is first applicable to county budgets for the fiscal year 2 7 beginning July 1, 1999. 2 8 EXPLANATION 2 9 This bill relates to and makes appropriations to the 2 10 property tax relief fund for county mental health, mental 2 11 retardation, and developmental disability (MH/MR/DD) 2 12 expenditures. 2 13 The bill amends Code section 426B.1, which creates the fund 2 14 and provides the standing limited appropriation to the fund. 2 15 The amendment incrementally increases the standing limited 2 16 appropriation of $95 million in current law to $220.78 million 2 17 over a three-year period beginning with fiscal year 1999-2000. 2 18 In addition, language is stricken in the standing limited 2 19 appropriation from the fund for purposes of medical assistance 2 20 (Medicaid) that provides for a reduction in the amount 2 21 distributed to counties and refers to a 50 percent 2 22 appropriation target that is repealed by the bill. 2 23 Code section 426B.2 is amended to strike a provision which 2 24 requires the property tax relief fund distributions to 2 25 continue until distributions are equal to 50 percent of the 2 26 combined county base year expenditures for MH/MR/DD services. 2 27 The bill takes effect upon enactment and is first 2 28 applicable to county budgets developed for the fiscal year 2 29 beginning July 1, 1999. 2 30 LSB 1387SS 78 2 31 jp/cf/24.1
