  1  1          SENATE CONCURRENT RESOLUTION NO.    
  1  2                BY  IVERSON and GRONSTAL
  1  3 A Senate Concurrent Resolution relating to a study of
  1  4    the issues involving railroad rights-of-way crossings
  1  5    by utilities.
  1  6    WHEREAS, legislation has been introduced and
  1  7 considered in both houses during the 2000 Session of
  1  8 the General Assembly, which legislation addresses
  1  9 procedures utilized by electric, natural gas,
  1 10 telephone, and rural water system interests, and their
  1 11 statewide associations, in extending utility services
  1 12 across railroad rights-of-way; and
  1 13    WHEREAS, various issues giving rise to the proposed
  1 14 legislation have not been resolved and many questions
  1 15 remain; and
  1 16    WHEREAS, it is necessary that public utilities and
  1 17 railroads have the ability to resolve problems which
  1 18 arise when public utilities seek rights-of-way across
  1 19 railroad property; and
  1 20    WHEREAS, public convenience and necessity, as well
  1 21 as safety standards for public utilities and
  1 22 railroads, must be a consideration of any legislation
  1 23 or other resolution of issues, and the public
  1 24 utilities and the railroad industry should resolve
  1 25 differences of opinion in the interests of the
  1 26 citizens of Iowa; NOW THEREFORE,
  1 27    BE IT RESOLVED BY THE SENATE, THE HOUSE OF
  1 28 REPRESENTATIVES CONCURRING, That representatives of
  1 29 Iowa electric, natural gas, telephone, rural water
  1 30 system, and railroad interests, and their statewide
  2  1 associations, meet following the 2000 Session of the
  2  2 General Assembly for the purpose of studying issues
  2  3 related to railroad rights-of-way crossings by
  2  4 utilities, consider the legislative solutions offered
  2  5 during the 2000 Session of the General Assembly, as
  2  6 well as additional proposals, make efforts to resolve
  2  7 legal and practical problems and differences of
  2  8 opinion, if necessary prepare legislation proposing
  2  9 solutions to the problems which exist, and prepare a
  2 10 detailed report regarding the efforts to resolve the
  2 11 problems and develop necessary legislation; and
  2 12    BE IT FURTHER RESOLVED, That the Iowa Utility
  2 13 Board, in cooperation with the state department of
  2 14 transportation, office of rail, facilitate the
  2 15 meetings of the parties involved by providing an
  2 16 administrative structure for such meetings pursuant to
  2 17 suggested procedures provided by the Iowa Utility
  2 18 Board and agreed to by the parties; and
  2 19    BE IT FURTHER RESOLVED, That a report regarding the
  2 20 efforts to resolve the problems, accompanied by
  2 21 suggested legislation, be forwarded to the Senate
  2 22 Majority and Minority Leaders and the Speaker of the
  2 23 House and the House Minority Leader not later than
  2 24 November 1, 2000.
