PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. 1 2 BY COMMITTEE ON NATURAL RESOURCES 1 3 AND ENVIRONMENT 1 4 (SUCCESSOR TO SSB 3139) 1 5 A Senate Concurrent Resolution to request that the 1 6 Congress of the United States maintain its 1 7 commitment to clean air and the ethanol industry, 1 8 by maintaining the oxygenate requirement in the 1 9 federal Clean Air Act that promotes the use of ethanol 1 10 in reformulated gasoline, and urging the United 1 11 States Environmental Protection Agency to resist 1 12 California's attempt to waive the oxygenate 1 13 requirement in that state. 1 14 WHEREAS, the federal Clean Air Act requires the use 1 15 of oxygenated motor vehicle fuels in order to improve 1 16 air quality in the nation's most polluted areas and to 1 17 reduce emissions of benzene and other ozone-forming 1 18 aromatic compounds associated with gasoline; and 1 19 WHEREAS, ethanol blended gasoline is an 1 20 environmentally safe oxygenate enhancer that may be 1 21 used in reformulated gasoline in order to comply with 1 22 the requirements of the federal Clean Air Act; and 1 23 WHEREAS, the Governor of California in Executive 1 24 Order D-5-99 has ordered the California Environmental 1 25 Protection Agency to work with Senator Feinstein and 1 26 the California congressional delegation to pursue a 1 27 permanent waiver of the federal Clean Air Act 1 28 requirements for oxygen content in reformulated 1 29 gasoline in California; and 1 30 WHEREAS, this nation's petroleum industry is 2 1 actively pursuing the removal of the oxygenate 2 2 requirement altogether from the United States 2 3 Environmental Protection Agency's Reformulated 2 4 Gasoline Program; and 2 5 WHEREAS, a federal waiver of the oxygenate 2 6 requirement in California, let alone nationwide 2 7 repeal, would be a devastating loss of a significant 2 8 opportunity for ethanol in this country; NOW 2 9 THEREFORE, 2 10 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 2 11 REPRESENTATIVES CONCURRING, That the Iowa General 2 12 Assembly encourages the Congress of the United States 2 13 to maintain its commitment to the federal Clean Air 2 14 Act by retaining oxygenate requirements and by 2 15 implementing standards that ensure the opportunity for 2 16 the use of ethanol blended gasoline in Phase II of the 2 17 Reformulated Gasoline Program, thereby preserving the 2 18 natural environment, protecting the public health, 2 19 reducing this nation's dependence upon foreign 2 20 petroleum, and providing additional markets; and 2 21 BE IT FURTHER RESOLVED, That the Iowa General 2 22 Assembly encourages the United States President, the 2 23 Administrator of the United States Environmental 2 24 Protection Agency, and the Congress of the United 2 25 States to oppose the waiver of the oxygen content 2 26 requirement from the United States Environmental 2 27 Protection Agency's Reformulated Gasoline Program in 2 28 California; and 2 29 BE IT FURTHER RESOLVED, That a copy of this 2 30 Resolution be sent by the Secretary of the Senate to 3 1 the President of the United States and the 3 2 Administrator of the United States Environmental 3 3 Protection Agency; and 3 4 BE IT FURTHER RESOLVED, That copies of this 3 5 Resolution be sent by the Secretary of the Senate to 3 6 the President of the Senate of the United States; the 3 7 Speaker of the House of Representatives of the United 3 8 States; the Majority and Minority Leaders of the 3 9 United States Senate; and the Majority and Minority 3 10 Leaders of the United States House of Representatives; 3 11 and 3 12 BE IT FURTHER RESOLVED, That copies of this 3 13 Resolution be sent by the Secretary of the Senate to 3 14 Iowa's congressional delegation. 3 15 LSB 5648SV 78 3 16 da/cf/24.1
