PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. 1 2 BY DRAKE 1 3 (COMPANION TO LSB 7229HH BY BRAUNS) 1 4 A Concurrent Resolution establishing a special 1 5 commission to study and make recommendations 1 6 concerning the impact of current and future state 1 7 replacement funds paid to local governments to mitigate 1 8 the effects of the elimination of the property tax on 1 9 industrial machinery, equipment, and computers. 1 10 WHEREAS, it was the intent of the General Assembly 1 11 to provide replacement funds to local governments to 1 12 mitigate the loss of property tax revenue resulting 1 13 from the elimination of industrial machinery, 1 14 equipment, and computers from the local property tax 1 15 base for a period of time sufficient to allow growth 1 16 from economic development to replenish the tax base; 1 17 and 1 18 WHEREAS, the manner of calculating claims for 1 19 reimbursement paid from the state replacement fund may 1 20 have a severe adverse fiscal impact on certain local 1 21 governments whose property tax base contained a 1 22 significant proportion of industrial machinery, 1 23 equipment, and computers; NOW THEREFORE, 1 24 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 1 25 REPRESENTATIVES CONCURRING, That the Legislative 1 26 Council is requested to establish a special commission 1 27 to study the current statutory system under which 1 28 reimbursement claims are calculated and funds paid by 1 29 the state to local governments to replace revenue lost 1 30 from the elimination of property tax on industrial 2 1 machinery, equipment, and computers; and 2 2 BE IT FURTHER RESOLVED, That the special commission 2 3 be comprised of twelve voting members with diverse 2 4 expertise in economic development and local government 2 5 finance and administration, including all of the 2 6 following: 2 7 1. Four members of the General Assembly with not 2 8 more than one member from each chamber being from the 2 9 same political party. The two senators shall be 2 10 appointed by the majority leader of the Senate after 2 11 consultation with the president of the Senate and the 2 12 minority leader of the Senate. The two 2 13 representatives shall be appointed by the Speaker of 2 14 the House of Representatives after consultation with 2 15 the majority and minority leaders of the House of 2 16 Representatives. 2 17 2. One member appointed by the Governor. 2 18 3. The director of the Iowa Department of Economic 2 19 Development or the director's designee. 2 20 4. The executive director of the Iowa League of 2 21 Cities or the executive director's designee. 2 22 5. The executive director of the Iowa State 2 23 Association of Counties or the executive director's 2 24 designee. 2 25 6. The president of the Iowa Municipal Finance 2 26 Officers Association or the president's designee. 2 27 7. The director of Revenue and Finance or the 2 28 director's designee. 2 29 8. An economist designated by the president of 2 30 Iowa State University of Science and Technology. 3 1 9. The president of the Professional Developers of 3 2 Iowa or the president's designee; and 3 3 BE IT FURTHER RESOLVED, That the chairpersons of 3 4 the special commission shall be the General Assembly 3 5 members of the majority party from each chamber; and 3 6 BE IT FURTHER RESOLVED, That the special commission 3 7 shall do all of the following: 3 8 1. Review the impact of the phase-out of property 3 9 taxation of industrial machinery, equipment, and 3 10 computers on individual units of local government. 3 11 2. Evaluate the impact, from an economic 3 12 development perspective, of the phase-out of property 3 13 taxation of industrial machinery, equipment, and 3 14 computers. 3 15 3. Assess the impact of state replacement funds in 3 16 mitigating the loss of local government revenue due to 3 17 the phase-out of property taxation of industrial 3 18 machinery, equipment, and computers. 3 19 4. Project the amount of replacement funds 3 20 necessary to pay reimbursement claims to local 3 21 governments through fiscal year 2006-2007. 3 22 5. Recommend modifications to the current 3 23 statutory system under which reimbursement claims are 3 24 calculated in order to further mitigate revenue loss 3 25 to those local governments for which the elimination 3 26 of the property tax on industrial machinery, 3 27 equipment, and computers will have a severe adverse 3 28 fiscal impact; and 3 29 BE IT FURTHER RESOLVED, That the special commission 3 30 shall convene, at a minimum, once each month, if 4 1 necessary; and 4 2 BE IT FURTHER RESOLVED, That the special commission 4 3 shall submit a final report to the General Assembly 4 4 and to the Governor for consideration during the 2001 4 5 legislative session, which report shall include, but 4 6 not be limited to, findings, analyses, and 4 7 recommendations by the special commission; and 4 8 BE IT FURTHER RESOLVED, That the Legislative 4 9 Council, pursuant to its authority in section 2.43 may 4 10 allocate funding from moneys available to it in 4 11 section 2.12, to the special commission created in 4 12 this Resolution for studies, consultants, surveys, and 4 13 reimbursement of any public or private department or 4 14 agency that provides staffing services for the 4 15 commission; and 4 16 BE IT FURTHER RESOLVED, That the members of the 4 17 General Assembly serving on the special commission 4 18 shall, by January 15, 2001, file their recommendations 4 19 for consideration during the 2001 legislative session. 4 20 LSB 7229SS 78 4 21 sc/cls/14
