  1  1    Amend House File 2502, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  By striking everything after the enacting
  1  4 clause and inserting the following:
  1  5    "Section 1.  Section 331.381, Code 1999, is amended
  1  6 by adding the following new subsection:
  1  7    NEW SUBSECTION.  19.  Provide for countywide law
  1  8 enforcement services for all cities and unincorporated
  1  9 areas of the county.  All law enforcement services
  1 10 within the county shall be funded from the county
  1 11 general fund.
  1 12    Sec. 2.  Section 364.3, Code Supplement 1999, is
  1 13 amended by adding the following new subsection:
  1 14    NEW SUBSECTION.  9.  A city shall not provide for
  1 15 law enforcement services within the city.  A city
  1 16 shall not budget or certify a tax for law enforcement
  1 17 services within the city.
  1 18    Sec. 3.  TRANSITION.
  1 19    1.  The county sheriff, the board of supervisors,
  1 20 and the mayor and council or commissioners of each
  1 21 city within the county shall provide for the orderly
  1 22 transfer of law enforcement services from each city to
  1 23 the county sheriff which shall be effective January 1,
  1 24 2001.  Prior to January 1, 2001, the board of
  1 25 supervisors shall convene a conference of affected
  1 26 mayors, council persons or commissioners, and the
  1 27 county sheriff.  The conference shall meet at the call
  1 28 of the board of supervisors to provide for an orderly
  1 29 transfer of law enforcement services from city police
  1 30 departments to the office of county sheriff.  The
  1 31 transfer plans shall include the transfer of law
  1 32 enforcement personnel including the transfer of civil
  1 33 service rights pensions, disability and other
  1 34 benefits.
  1 35    2.  Each city shall transfer, effective January 1,
  1 36 2001, city funds budgeted for law enforcement services
  1 37 from January 1, 2001, through June 30, 2001.  The
  1 38 transfer shall also include supplies and equipment
  1 39 related to law enforcement.  A city shall not budget
  1 40 or certify a tax levy to fund law enforcement services
  1 41 for the fiscal year beginning July 1, 2001, or
  1 42 subsequent fiscal years.
  1 43    Sec. 4.  EFFECTIVE DATES.
  1 44    1.  Sections 1 and 2 of this Act take effect
  1 45 January 1, 2001.
  1 46    2.  Section 3 takes effect July 1, 1999."
  1 47    #2.  Title page, by striking lines 1 through 3 and
  1 48 inserting the following:  "An Act relating to
  1 49 provisions of countywide law enforcement service by
  1 50 the county sheriff and the transfer of law enforcement
  2  1 powers and duties of cities to the county."
