  1  4 RELATING TO FEE-SUPPORTED SERVICES PROVIDED BY A COUNTY
  1  5    INCLUDING THE PAYMENT OF COUNTY LAW ENFORCEMENT SALARIES
  1  6    AND EXPENSES AND PROVIDING APPLICABILITY DATES.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 331.421, subsection 1, Code 1999, is
  1 11 amended to read as follows:
  1 12    1.  "General county services" means the services which are
  1 13 primarily intended to benefit all residents of a county,
  1 14 including secondary road services and fee-supported services,
  1 15 but excluding services financed by other statutory funds.
  1 16    Sec. 2.  Section 331.421, Code 1999, is amended by adding
  1 17 the following new subsection:
  1 18    NEW SUBSECTION.  10.  "Fee-supported service"  means a
  1 19 service provided to a city for payment of a fee or pursuant to
  1 20 an agreement entered into pursuant to chapter 28E.
  1 21    Sec. 3.  Section 331.427, subsection 2, Code 1999, is
  1 22 amended by adding the following new paragraph:
  1 23    NEW PARAGRAPH.  n.  Salary costs and expenses incurred in
  1 24 the performance of law enforcement responsibilities, including
  1 25 but not limited to:
  1 26    (1)  Law enforcement services provided by the sheriff as
  1 27 defined in section 331.101.
  1 28    (2)  Duties performed by the sheriff pursuant to section
  1 29 331.322 or chapter 34.
  1 30    (3)  Powers and duties performed by the sheriff pursuant to
  1 31 sections 331.651 through 331.661 and the county jail and
  1 32 detention facilities pursuant to chapters 356 and 356A.
  1 33    (4)  Salaries and expenses related to law enforcement
  1 34 positions established pursuant to section 331.323, subsection
  1 35 2, and section 331.904, subsection 2.
  2  1    Sec. 4.  APPLICABILITY.
  2  2    1.  This Act shall apply to all counties except those
  2  3 counties described in subsection 2.
  2  4    2.  This Act shall not apply to counties which budgeted or
  2  5 funded, for the fiscal year beginning July 1, 1999,
  2  6 expenditures identified in section 3 of this Act from the
  2  7 rural services fund, unless the counties increase the funding
  2  8 from the rural services fund above the amount in the budget
  2  9 certified on or before March 15, 2000.
  2 10    3.  However, this Act shall also apply to counties
  2 11 described in subsection 2, after the last day of the regular
  2 12 session of the general assembly which convenes following the
  2 13 final disposition of litigation pending before the district
  2 14 court of Lyon or Story county addressing the issue of funding
  2 15 of uniform law enforcement patrol services provided by the
  2 16 county sheriff, whichever decision is issued last.
  2 17    4.  However, this Act shall also apply to Lyon county and
  2 18 Story county upon disposition of their respective litigation
  2 19 pending before the district courts of Lyon or Story county
  2 20 addressing the funding of expenditures specified in section 3
  2 21 of this Act, respectively.  However, subsection 3 shall apply
  2 22 to Lyon or Story county if this Act is inconsistent with the
  2 23 applicable final order or ruling in each case.
  2 24    Sec. 5.  INTERIM STUDY ON FUNDING COUNTY SHERIFFS.  The
  2 25 legislative council is requested to establish an interim study
  2 26 to study all aspects of the funding of law enforcement
  2 27 services of the office of county sheriff.  The findings and
  2 28 recommendations of the study committee shall be reported to
  2 29 the legislative council and the general assembly.
