1 1 Amend Senate File 2348, as passed by the Senate, as
1 2 follows:
1 3 #1. Page 1, by inserting after line 10 the
1 4 following:
1 5 "Sec. . Section 161D.1, Code Supplement 1999,
1 6 is amended by adding the following new subsection:
1 7 NEW SUBSECTION. 5. If it is economically
1 8 feasible, a public agency or a recipient of a public
1 9 grant or contract shall use alternative materials for
1 10 fill dirt for a public project in lieu of the use of
1 11 loess soils from the loess hills."
1 12 #2. Page 1, by inserting after line 10 the
1 13 following:
1 14 "Sec. . Section 161D.1, Code Supplement 1999,
1 15 is amended by adding the following new subsection:
1 16 NEW SUBSECTION. 5. a. In matters relating to the
1 17 loess hills, state agencies shall cooperate with the
1 18 loess hills development and conservation authority,
1 19 the hungry canyons alliance, or the loess hills
1 20 alliance in carrying out their respective studies,
1 21 planning, and programs as authorized under this
1 22 chapter. The cooperation and assistance requested
1 23 shall only be provided subject to staff and budgetary
1 24 limitations of an assisting state agency and shall not
1 25 be provided if such provision would adversely affect
1 26 an assisting state agency in its administration of its
1 27 own principal duties and programs.
1 28 b. If a state agency initiates a project or awards
1 29 a grant or contract to another party which may affect
1 30 the work plans of the hungry canyons alliance or the
1 31 loess hills alliance, the state agency may notify the
1 32 authority or the affected alliance of the project. If
1 33 an adverse effect on the work plans of either alliance
1 34 is expected, the state agency may confer with the
1 35 affected alliance for the purposes of resolving or
1 36 mitigating the potential adverse effects."
1 37 #3. Page 1, by inserting after line 16 the
1 38 following:
1 39 "Sec. . STUDY AND REPORT. The loess hills
1 40 development and conservation authority shall study the
1 41 feasibility of incorporating the powers and duties of
1 42 the Missouri river preservation and land use authority
1 43 established under chapter 463B within the loess hills
1 44 development and conservation authority. The loess
1 45 hills development and conservation authority shall
1 46 report its findings and recommendations to the general
1 47 assembly pursuant to section 7A.11 not later than
1 48 January 1, 2001."
1 49 #4. Title page, line 2, by striking the words
1 50 "alliance and" and inserting the following:
2 1 "alliance,".
2 2 #5. Title page, line 4, by inserting after the
2 3 word "alliance" the following: ", and providing for
2 4 the assistance of state agencies".
2 5 #6. By renumbering, relettering, or redesignating
2 6 and correcting internal references as necessary.
