  1  1    Amend House File 433, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 1, line 9, by striking the word
  1  4 "duration." and inserting the following:  "duration,
  1  5 and which satisfies all of the following:
  1  6    (1)  Provides for the signature and initials of the
  1  7 consumer on each page of the contract and is so signed
  1  8 and initialed by the consumer.
  1  9    (2)  Clearly and conspicuously sets forth on the
  1 10 first page of the contract any fee for cancellation of
  1 11 the contract, and provides a separate space for the
  1 12 consumer to initial the agreement with respect to the
  1 13 acceptance of such cancellation fee.
  1 14    (3)  Clearly and conspicuously sets forth any
  1 15 waiver on the part of the consumer to bring an action
  1 16 in court against the service provider, and provides a
  1 17 separate space for the consumer to initial the
  1 18 agreement with respect to the acceptance of such
  1 19 waiver.
  1 20    (4)  Clearly and conspicuously sets forth on the
  1 21 first page of the contract any nonstandard terms and
  1 22 conditions, terms and conditions which are to be
  1 23 negotiated between the service provider and the
  1 24 individual consumer, and any terms or conditions which
  1 25 establish financial obligations on the part of the
  1 26 consumer.
  1 27    (5)  Provides for a notice to be mailed to the
  1 28 consumer, separate from any other mailing made by the
  1 29 service provider to the consumer, which gives notice
  1 30 to the consumer of any automatic renewal of the
  1 31 agreement, and which notice is mailed to the consumer
  1 32 no more than thirty days or less than twenty days
  1 33 prior to the date of such automatic renewal."
