PAG LIN 1 1 Amend House File 476, as amended, passed, and 1 2 reprinted by the House, as follows: 1 3 #1. Page 21, by inserting after line 18 the 1 4 following: 1 5 "Sec. 101. Section 368.19, unnumbered paragraph 1, 1 6 Code 1999, is amended to read as follows: 1 7 The committee shall approve or disapprove the 1 8 petition or plan as amended, within ninety days of the 1 9 final hearing, and shall file its decision for record 1 10 and promptly notify the parties to the proceeding of 1 11 its decision. If a petition or plan is approved, the 1 12 board shall set a date not less than thirty days nor 1 13 more than ninety days after approval for a special 1 14 election on the proposal and the county commissioner 1 15 of elections shall conduct the election. In a case of 1 16 incorporation or discontinuance, registered voters of 1 17 the territory or city may vote, and the proposal is 1 18 authorized if a majority of those voting approves it. 1 19 In a case of annexationor severance, registered 1 20 voters of the territory and of the city may vote, and 1 21 the proposal is authorized if a majority of the total 1 22 number of persons residing in the territory and voting 1 23 approves it and if a majority of the total number of 1 24 persons residing in the city and voting approves it. 1 25 In case of severance, registered voters of that area 1 26 of the city to be severed and of the remainder of the 1 27 city may vote, and the proposal is authorized if a 1 28 majority of the total number of persons residing in 1 29 the area to be severed and voting approves it and if a 1 30 majority of the total number of persons residing in 1 31 the remainder of the city and voting approves it. 1 32 However, if there are no registered voters in the 1 33 territory to be severed or annexed, a special election 1 34 on the proposal shall not be conducted and the 1 35 proposal shall be implemented as if the proposal was 1 36 approved at a special election. In a case of 1 37 consolidation, registered voters of each city to be 1 38 consolidated may vote, and the proposal is authorized 1 39 only if it receives a favorable majority vote in each 1 40 city. The county commissioner of elections shall 1 41 publish notice of the election as provided in section 1 42 49.53 and shall conduct the election in the same 1 43 manner as other special city elections." 1 44 #2. Page 24, by inserting after line 24 the 1 45 following: "This section and section 101 of this Act, 1 46 amending section 368.19, being deemed of immediate 1 47 importance, take effect upon enactment and section 101 1 48 applies to any special election conducted pursuant to 1 49 section 368.19 after the effective date of this 1 50 section of this Act to approve or disapprove a 2 1 petition pending before the city development board 2 2 before, on, or after the effective date of this 2 3 section of this Act." 2 4 #3.
