PAG LIN 1 1 Amend Senate File 115, as passed by the Senate, as 1 2 follows: 1 3 #1. Page 3, by inserting after line 5 the 1 4 following: 1 5 "Sec. . Section 730.5, subsection 9, paragraph 1 6 c, subparagraph (2), Code 1999, is amended to read as 1 7 follows: 1 8 (2) If an employer does not have an employee 1 9 assistance program, the employer must maintain a 1 10 resource file ofemployee assistance services1 11providers,alcohol and other drug abuse programs 1 12 certified by the Iowa department of public health, 1 13 mental health providers, and other persons, entities, 1 14 or organizations available to assist employees with 1 15 personal or behavioral problems. The employer shall 1 16 provide all employees information about the existence 1 17 of the resource file and a summary of the information 1 18 contained within the resource file. The summary 1 19 should contain, but need not be limited to, all 1 20 information necessary to access the services listed in 1 21 the resource file.In addition, the employer shall1 22post in conspicuous places a listing of multiple1 23employee assistance providers in the area.1 24 Sec. . Section 730.5, subsection 9, paragraph 1 25 g, unnumbered paragraph 1, Code 1999, is amended to 1 26 read as follows: 1 27 Upon receipt of a confirmed positive alcohol test 1 28 which indicates an alcohol concentration greater than 1 29 the concentration level established by the employer 1 30 pursuant to this sectionbut less than the1 31concentration level in section 321J.2 for operating1 32while under the influence of alcohol, and if the 1 33 employer has at least fifty employees, and if the 1 34 employee has been employed by the employer for at 1 35 least twelve of the preceding eighteen months, and if 1 36 rehabilitation is agreed upon by the employee, and if 1 37 the employee has not previously violated the 1 38 employer's substance abuse prevention policy pursuant 1 39 to this section, the written policy shall provide for 1 40 the rehabilitation of the employee pursuant to 1 41 subsection 10, paragraph "a", subparagraph (1), and 1 42 the apportionment of the costs of rehabilitation as 1 43 provided by this paragraph. 1 44 Sec. . Section 730.5, subsection 9, paragraph 1 45 h, Code 1999, is amended to read as follows: 1 46 h. In order to conduct drug or alcohol testing 1 47 under this section, an employer shall require 1 48 supervisory personnel of the employer involved with 1 49 drug or alcohol testing under this section to attend a 1 50 minimum of two hours of initial training and to 2 1 attend, on an annual basis thereafter, a minimum of 2 2 one hour of subsequent training. The training shall 2 3 include, but is not limited to, information concerning 2 4 the recognition of evidence of employee alcohol and 2 5 other drug abuse, the documentation and corroboration 2 6 of employee alcohol and other drug abuse, and the 2 7 referral of employees who abuse alcohol or other drugs 2 8 to the employee assistance program or to the resource 2 9 fileof employee assistance services providers2 10 maintained by the employer pursuant to paragraph "c", 2 11 subparagraph (2)." 2 12 #2.
