1 1 Amend Senate file 292 as follows:
1 2 #1. Page 1, by striking lines 3 through 9 and
1 3 inserting the following:
1 4 "NEW UNNUMBERED PARAGRAPH. All complaint files,
1 5 investigation files, other investigation reports, and
1 6 other investigative information in the possession of
1 7 the board or its employees or agents, which relate to
1 8 licensee discipline, are privileged and confidential,
1 9 and are not subject to discovery, subpoena, or other
1 10 means of legal compulsion for their release to a
1 11 person other than the respondent and the board and its
1 12 employees and agents involved in licensee discipline,
1 13 and are not admissible in evidence in a judicial or
1 14 administrative proceeding other than the proceeding
1 15 involving licensee discipline. However, investigative
1 16 information in the possession of the board or its
1 17 employees or agents which relates to licensee
1 18 discipline may be disclosed to appropriate licensing
1 19 authorities within this state, the appropriate
1 20 licensing authority in another state, the District of
1 21 Columbia, or a territory or country in which the
1 22 licensee is licensed or has applied for a license. A
1 23 final written decision and finding of fact of the
1 24 board in a disciplinary proceeding is a public
1 25 record."
