1 4 PROVIDING FOR THE DESIGNATION OF INVESTIGATIVE INFORMATION
1 5 POSSESSED BY THE BOARD OF EDUCATIONAL EXAMINERS AS PRIVILEGED
1 6 AND CONFIDENTIAL.

1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 10 Section 1. Section 272.13, Code 1999, is amended by adding
1 11 the following new unnumbered paragraph:
1 12 NEW UNNUMBERED PARAGRAPH. All complaint files,
1 13 investigation files, other investigation reports, and other
1 14 investigative information in the possession of the board or
1 15 its employees or agents, which relate to licensee discipline,
1 16 are privileged and confidential, and are not subject to
1 17 discovery, subpoena, or other means of legal compulsion for
1 18 their release to a person other than the respondent and the
1 19 board and its employees and agents involved in licensee
1 20 discipline, and are not admissible in evidence in a judicial
1 21 or administrative proceeding other than the proceeding
1 22 involving licensee discipline. However, investigative
1 23 information in the possession of the board or its employees or
1 24 agents which relates to licensee discipline may be disclosed
1 25 to appropriate licensing authorities within this state, the
1 26 appropriate licensing authority in another state, the District
1 27 of Columbia, or a territory or country in which the licensee
1 28 is licensed or has applied for a license. A final written
1 29 decision and finding of fact of the board in a disciplinary
1 30 proceeding is a public record.
