PAG LIN 1 1 Section 1. Section 200.3, Code 1999, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 15A. "Organic agricultural product" means 1 4 the same as defined in section 190C.1. 1 5 Sec. 2. Section 200.20, Code 1999, is amended to read as 1 6 follows: 1 7 200.20 PHOSPHORIC ACID, NITROGEN AND POTASH REQUIREMENTS. 1 8 1.No phosphaticExcept as provided in subsection 2, a 1 9 person shall not sell, offer for sale, or distribute, any of 1 10 the following: 1 11 a. Phosphatic fertilizer containing less than eighteen 1 12 percent available phosphoric acid (P205), nor any nitrogen. 1 13 b. Nitrogen fertilizer containing less than fifteen 1 14 percent total nitrogen (N), nor any potash. 1 15 c. Potash fertilizer containing less than fifteen percent 1 16 soluble potash (K2O), nor any mixed. 1 17 d. Mixed fertilizer in which the sum of the guaranteed 1 18 analysis of total nitrogen (N), available phosphoric acid 1 19 (P2O5), and soluble potash (K2O), totals less than twenty 1 20 percentshall be offered for sale, sold, or distributed in1 21this state.This section1 22 2. Subsection 1 shallneithernot apply tospecialty1 23fertilizers as defined in section 200.3, subsection 23, nor to1 24 any of the following: 1 25 a. A specialty fertilizer. 1 26 b. A fertilizer designed to be applied and ordinarily 1 27 applied directly to growing plant foliage to stimulate further 1 28 growth. 1 29 c. Compost materials to be applied on land, if any of the 1 30 following apply: 1 31 (1) The land is being used to produce an agricultural 1 32 commodity that is an organic agricultural product. 1 33 (2) The land is in the transition of being used to produce 1 34 an agricultural commodity that is an organic agricultural 1 35 product, pursuant to rules adopted by the department as 2 1 provided in chapter 190C. 2 2 EXPLANATION 2 3 This bill amends Code chapter 200, which authorizes the 2 4 department of agriculture and land stewardship to regulate 2 5 fertilizers and soil conditioners, including by providing 2 6 standards for their effective use. Code section 200.20 2 7 provides that phosphatic fertilizer, nitrogen fertilizer, 2 8 potash fertilizer, or a mixed fertilizer cannot be sold in the 2 9 state unless it meets standards for chemical content. The 2 10 Code section provides that this prohibition does not apply to 2 11 specialty fertilizers or fertilizers applied directly to 2 12 growing plants. This bill provides that the prohibition also 2 13 does not apply to compost materials to be applied on land, if 2 14 the land is being used to produce an agricultural commodity 2 15 that is an organic agricultural product under Code chapter 2 16 190C or is in the transition of being used to produce an 2 17 organic agricultural commodity. 2 18 LSB 6479HC 78 2 19 da/cf/24
